CONFIDENTIEL 8 MARS2023 Projet de restriction PFAS : violations procdurales et des dispositions du rglement REACH et des principes gnraux du droit de l'Union euro1;>enne SYNTHESE Le projet de restriction PFAS tel que publi par l'ECHA sur son site internet le 7 fvrier 2023 est entach d'irrgularits procdurales et ne respecte ni les conditions fixes par le rglement REACH pour l'adoption d'une restriction ni les principes gnraux du droit de l'Union europenne comme suit : Sur la violation de la procdure d'adoption de la restriction : Violation de la procdure d'adoption d'une restriction prvue le rglement REACH en ce que : o le dossier de restriction a t transmis l'ECHA le 13 janvier 2023, soit plusieurs mois aprs l'chance d'un an requise par l'alina 1 de l'article 69(4) du rglement aprs la notification de l'intention de soumettre un dossier de restriction (le 15 juillet 2021 s'agissant du dossier de restriction PFAS) ; o le comit de l'ECHA aurait d transmettre son avis sur la conformit du dossier de restriction (par rapport l'annexe XV du rglement) dans les 30 jours suivant la transmission du dossier l'ECHA, soit avant le 13 fvrier 2023 conformment l'alina 3 de l'article 69(4) du rglement ; or, cet avis n'a toujours pas t rendu ce jour et selon le communiqu de presse de l'ECHA du 7 fvrier 2023, la conformit du dossier de restriction ne sera contrle par le comit de l'ECHA qu'en mars 2023 ; o le dossier de restriction a t publi par l'ECHA avant que sa conformit n'ait t contrle par les comits en violation avec l'article 69(6) du rglement - en toute hypothse, l'ajout d'une mention pre-publication (tape procdurale non prvue par le rglement) sur le dossier de restriction publi ne saurait tre de nature reporter l'obligation d'assurer le contrle de conformit du dossier dans les 30 jours requise l'alina 3 de l'article 69(4) du rglement.
