Workmen's Compensatio filed 5-23-71: Our file #72-3859
Dear Mr* Parks:
It has been some time since our last/conversation regarding the above
former employee at our Detroit paipt plant* It was my understanding
that you had contacted
attorney about an offer of settle
ment of this claim.
James Parise of our Detroit factory Personnel Department advises that
is in poor health/and the temptation to take a lump-sum settle
ment may be reinforced by this factor. We are concerned about several
points.
/
Some consideration should be given to the amounts of money already
paid to .
und#r our Company disability plan* It seems
was granted disability-retirement status on the basis that he
had a personal type/of disability, which seriously impaired his
ability to perform/gainful employment. In good faith, Sherwin-Williams
paid him benefits/under this plan from April 1973*
Later
filed a petition alleging that his disability was
work related./His petition has been granted, and we are ordered to
pay benefitsyin accordance with the Workmen's Compensation Act* How
ever, our Company plan states that an offset for Workmen's Compensa
tion benefits will reduce the amount of those benefits. Thus, retro
actively, ythe claimant owes us some money* We would appreciate your
thoughts/on this matter.
Another point which concerns me is the potential for a death claim
from
survivors, should he die of the disabilities alleged

in his claim. Could you advise whether a settlement of claim will obviate the death claim liability which may exist?
Very truly yours,
