The rule incorporates by reference the 2017 version of Department Circular DEQ-8 concerning standards for subdivision storm drainage to clarify drainage review requirements and provide information on new technologies that can be used to design drainage facilities. The rule also removes design requirements and updates applicable fees and provisions concerning applications, review procedures, board of health certifications, storm drainage plans, professional engineer-designed systems, and sewage and water supply Sierra Club v. Contact: Sandy Scherer; DEQ; 406-444-4386; sscherer@mt.gov --Montana Administrative Register (09/22/2017) Regulatory Update WATER Water Right Permitting Montana WATER Notice of the Department of Natural Resources and Conservation announces an extension of the comment period for a Sept. 8, 2017, proposed rule to amend regulations under ARM 36.12,101 through .1801 (nonconsecutive) and repeal regulations under ARM 37.12.106 to update water rights permitting standards and procedures. The rule adds notice requirements for temporary appropriations of water for emergency fire training and clarifies that no filing fee refunds will be authorized after the department has issued a deficiency letter to applicants. The rule also adds requirements for objections concerning adverse effects to instream flow rights for fish, wildlife, and recreation; clarifies aquifer testing requirements; and adds permit application requirements for projects in sage grouse habitats. In addition, the rule clarifies deficiency letter timelines and outcomes and acceptable surface water measurement data and removes duplicative provisions concerning testing and monitoring. Finally, the rule updates the definition of "combined appropriation" and removes the definition of "municipal use" to conform with judicial decisions. The comment period is extended to allow the Water Policy Interim Committee to review and discuss the proposal. Comments now are due Oct. 20, 2017. The rule requires reinspection of certain motor vehicles of model year 1995 or older, certain heavy-duty vehicles of model year 1996 or newer, and certain motor vehicles powered by diesel engines that have failed an inspection for an improper gas or fuel cap. The workshop is scheduled for Oct. 16, 2017, and the hearing is scheduled for Nov. 6, 2017, both in Carson City and via teleconference in Las Vegas. Comments are due Oct. 13, 2017.
