This was an EPA inspection in response to the complaint of a purging well located very near, and possibly impacting a nearby waterbody. The purpose of the inspection was to investigate possible brine impacts into Little Hominy Creek from the purging well. There was no operator representative present during the inspection. The inspection was conducted by the authority of the Clean Water Act (CWA) to determine compliance with Environmental Protection Agency (EPA) regulations. There was no other federal, state, or local agency representative present at the time of the inspection. FACILITY DESCRIPTION EPA conducted an inspection at the Calgary Energy, LLC, Tidal Osage I Lease, where a temporarily abandoned production well was purging brine to the surface. The brine was migrating toward nearby Little Hominy Creek. Section II - OBSERVATIONS I observed the capped well and the area of brine saturated soil around the well, which can be seen in photos No. 1 and 2 of Appendix 1 (photo log). All photos in the inspection were taken within 30 feet of GPS location (36.541797, -96.401344). I observed the area where brine impacts travelled over the bank and migrated downgrade toward Little Hominy Creek. Damp soil and white crystalized brine was visible across the impacted area. See photos No. 3 and 4 in the attached photo log. I observed a small area where brine/air/gas was bubbling up approximately 5 feet from the capped well, evidence of an ongoing leak from the well. See photo No. 5. Section III - AREAS OF CONCERN The primary area of concern is to immediately stop the well from purging brine and prevent brine from entering nearby Little Hominy Creek. Brine impacted soil should be removed from the location to prevent brine washing into the waterway during future rainfall events. 2 Section IV - FOLLOW UP Calgary Energy, LLC / Tidal Osage I Lease Inspection Date 04/13/2023 As a closing conference, inspector contacted Blaine Haag and Duane Easley, Calgary Energy representatives, and requested immediate action related to the areas of concern and to prevent additional brine being released from the well. Calgary Energy responded within an hour, dug around the well and replaced the leaking fittings to prevent further brine from escaping the well. Calgary Energy also agreed to seek emergency approval from the Bureau of Indian Affairs (BIA) to properly plug the well to prevent future recurrence. Inspector also contacted BIA Osage Agency, Lee Burnett, Mike Perrier, Alfred McKinley and Steven Kohler to alert their office of the importance of the emergency plugging request from Calgary Energy.
