Mr. Balch and his attorney indicated to the Town, USACE, CTDEEP and EPA that he wanted to resolve the matter. Approximately 1-2 acres of fill. West of the tributary is agricultural fields. Property extends half mile north and west from fill area. Purpose and Need for Discharge of Dredged and / or Fill Material Mr. Balch claimed the fill was for maintenance. Site Overview (Past inspections, site description, permits, etc.) The Town of East Windsor had been out to the site on 11-4-2020 to document alleged fill Scope of Inspection (Areas inspected or not inspected) The area where the fill had been deposited. Closing Conference Documents Received and / or Requested During the Inspection N / A Compliance Assistance Provided (If any) N / A Observations Relayed to Site Owner / Operator Cori Rose informed Mr. Balch that there appeared to be a CWA section 404 violation. Cori explained that restoration would be necessary to resolve the matter and that Mr. Balch needs to work with the town to create a satisfactory restoration plan. Cori told him that before the restoration can occur, Mr. Balch needs to hire a wetlands scientist that can delineate the wetland area as well as determine the parent material below the fill. I informed Mr. Balch that EPA has the discretion to take an action and will be monitoring the matter and that he should cooperate with the town to restore the wetland.
