I'm based in Fairfax County. I'm working on a story for Argus Rail Business looking at who is liable when a hazardous spill occurs as a result of a train derailment. There has been some going back and forth between shippers and the railroads over who is liable. Are there any pending regulations or actions that might address this issue? I also learned that while the Federal Railroads Administration normally sets rail regulations, because of the handling hazardous materials component, any rulemaking on this issue would come from the EPA.
