Dr. Bernstein has concluded that the claimant had a small deep hemisphere infarct. Based upon his evaluation. Dr. Bernstein concluded that the cerebrovascular accident should not have been found job related. Of course, this is also what Dr. MacNabb concluded. However, the Administrative Law Judge tended to ignore Dr. MacNabb1s conclusions. As you and I have discussed before, there is a great deal of of sympathy in this case since the claimant made a very convincing witness. I am enclosing a copy of Dr. Bernstein's notes from his office visit on September 23. I have placed his statement in line for payment. Bernstein concluded that the claimant has right hemiparesis. This suggested a left sub-cortical lesion. At the time of the visit, the claimant was still experiencing right hemiparesis. Dr. MacNabb has not made a decision as to whether or not the claimant is able to return to any type of work. I will follow up with another request to him. If he would release him to some form of light duty work, we could institute vocational rehabili tation to try to get this claimant back to some form of suitable employment.
