In connection with the activities of the PFOA ECA Monitoring Workgroup, we are supplementing our Januaiy 14, 2004 and February 2, 2004 letters on the referenced topic with copies of additional documents relating to environmental modeling/sampling for PFOA by DuPont at facilities in Dordrecht, Netherlands, Shimizu, Japan, Fayetteville, North Carolina, and Washington Works, West Virginia. The following documents are enclosed:-
- As a Defendant in a class action lawsuit pending against DuPont in the West Virginia State Court in which we serve as Class counsel, DuPont has the right to mark documents produced in that case as falling under the terms of a Stipulated Protective Order, that allows parties to limit distribution of documents, if they qualify as documents for which "Confidential Business Information" (CBI), protection would be available. Although the enclosed documents were produced to us in that litigation, none of the enclosed copies have been stamped "confidential" by DuPont under terms of that Stipulated Protective Order.
