I met with Seth Busby at the Opening Conference. I presented my credentials to Mr. Busby and informed him that this was an EPA inspection to determine the facility's compliance with the Clean Water Act (CWA) National Pollutant Discharge Elimination System (NPDES) Concentrated Animal Feeding Operation (CAFO) regulations and the facility's Texas Commission on Environmental Quality (TCEQ) General Permit. The scope of the inspection was a Compliance Evaluation Inspection. Following the opening conference, Mr. Busby accompanied me on the site inspection. FACILITY DESCRIPTION Busby Dairy is a permitted facility that has approximately 660 cattle. At the time of the inspection, according to Mr. Busby, the facility was milking 40 cows. In addition to the milking cows, Mr. Busby notified us that there were approximately 40 head of dry cows, 130 calves and 450 heifers. 40 cows are milked twice per day and between sessions kept in pasture. Section II - OBSERVATIONS Retention Control Structure (RCS): At the time of the inspection, Busby Dairy had two RCSs, one solids settling basin and one storage pond. I observed that both RCSs were in good condition, were adequately fenced-off, and met the storage capacity requirements delineated in the facility's General CAFO Permit (TXG920052 Part III.A.6(f)(6)) (Photos #2-3). Land Application Areas: Mr. Busby informed me that land application of the facility's wastewater happens only once every approximately five years when the RCSs are cleaned out. Dewatering Equipment: At the time of the inspection, the dewatering equipment for Busby Dairy was being stored at the main milking facility. Mortality Management Area: At the time of the inspection, Mr. Busby informed me that all mortalities which occur onsite are added to a burn pile onsite and burned as soon as possible. I observed the burn pile to be in adequate condition if burned soon (photo #4). Mr. Busby notified me that he intended to burn the pile as soon as weather permitted. Commodities Storage: At the time of the inspection, all feed was being stored under cover in a barn.
