Revision No. 1 of Amendment No. 9 to Agreement dated May 21, 1964 THIS AGREEMENT, made and entered into as of April 3, 1970 by and between ARMCO STEEL CORPORATION (hereinafter referred to as "Owner") and KAISER ELGINEERS, INC. (hereinafter referred to as "Contractor"), WITNESSETH: WHEREAS, Owner andContractor on May 21, 1964, entered into an Agreement for engineering, construction, and other services to be performed by Contractor relating to Owner's proposed expansion and modernization program at its Middletown Works and its Butler Works (hereinafter referred to as "Agreement"), the Agreement having been heretofore amended; and WHEREAS, Owner has indicated its desire to have Contractor perform engineering services only for a project included in Owner's expansion and modernization program at its Middletown Works in addition to those engineering only projects set forth in Amendment No. 9 of the Agreement and the parties desire to revise said Amendment No. 9 to provide for Contractor's performance of such additional engineering only services. NOW, THEREFORE, IT IS AGREED: 1. Section A-5 as added to the Agreement by Amendment No. 9 is hereby revised as follows to include item c): "Section A-5 Contractor shall provide hereunder engineering services only with respect to the following projects of the Middletown expansion and modernization program, such services being included within "The Work" and being hereinafter sometimes referred to as "Engineering Only Services": a) Project No. 7144 - Additional Soaking Pits b) Project No. 7185 - Fume Abatement - No. 2 Open Hearth c) Project No. 714-7 - No. 4 Slab Furnace and Waste Heat Boiler" KEN 007700 1- - 40870 I Except as herein expressly amended, the provisions of the Agreement and prior amendments shall remain in full force and effect.
