However, the proposal did not provide any method to determine the value of crushed and ground day. The Treasury praposais made no effort to solve this primary problem which has been plaguing the refractories industry for seven years. The government contended that there was a market for raw are day, but the only raw day sales produced in substantiation of this market -were wprmoteiy 73 m.-ics distant from the taxpayer's plant, i.-.e District Court held that these sales did not establish a market for ra-w Ere day in the area of Car.r.eitcn and allowed end product depiction to the taxpayer. Tms case will probably be appealed to the Seventh Circuit Court. In the Spurts Cersmic Company case the taxpayer brought suit for end product depiction in the U. S.
