J. Willett, chairman, convened the meeting at 9:30 a.m. Presentations on the U.S Regulatory Agenda and a Coalition of Northeast Governors Source Reduction Initiative were added to the meeting agenda. 2. Minutes Minutes of the August 15, 1990, meeting were approved as corrected to reflect that P. Lewis was absent. 3. Budget T. Marriott reviewed the budget, noting approximately $157,000 in approved spending and $130,000 in requests before the Committee. 4. stearin* Task Group T. Marriott reported Steering Task Group discussions on: o current Committee budget requests; o rescheduled Committee review of the Community Focus Area Workplan to December 1990 or January 1991; and o rescheduled joint meeting with International Affairs Committee to November 14, 1990. 5. September 1990 Board of Directors Meeting J. Willett briefed the Committee on the September 1990 Board of Directors meeting, noting: o Board approval of the Process Safety Code of Management Practice under Responsible Care; o Board approval of recommendations to proceed with Phase II of the OECD Existing Chemical Testing program; progress will be reported to the Board in November 1990 and January 1991; and o Executive Committee briefing on the Ad Hoc Risk Study Group workplan; resource requirements will be reported to the Board in November 1990. 6. Regulatory Program of the United States L. King presented major aspects of the recently released Regulatory Program of the United States, noting sections on risk assessment, risk management and regulatory impact analysis guidelines. Implications to past, current, and future regulations and CMA initiatives were discussed. cMA 061050 HSC Meeting Minutes September 26, 1990 Page 3 7. Risk A. D. Sigman reviewed the basis and history of CMA's Ad Hoc Study Group on Risk and asked that the Committee approve expenditure of $100,000 to initiate the Risk Management Coalition, CMA will work to secure additional sponsors for the Coalition and will report progress and additional resource needs to the Board of Directors in November 1990. The first coalition meeting is targeted for late November 1990. The Committee approved the expenditure B. L. Smith reviewed position papers on technical issues common to risk assessment in environmental regulations and asked that the Committee approve the papers for use in CMA comments and distribution to internal and external contacts. The Committee approved the position papers. C. L. Smith reviewed the Layman's Guide to Decision Analysis developed with the technical assistance of Robert Sielken and requested approval of the final document. The Committee approved the request. 8. rT-r-lnnflpTii; L. Smith requested that the Committee approve expenditure of $3,000 to support travel expenses for two CMA representatives to attend the October 9, 1990, ECETOC meeting in Brussels, Belgium on industry collaboration with IARC. CMA representatives to the meeting are Dr. Robert Moolenaar (Dow) and Dr. Neil Krivanek (du Pont. The Committee approved the expenditure. 9. CONEG Source Reduction Council Bill Margaritas (Occidental; CMA State Affairs Committee) briefed the Committee on the Coalition of Northeast Governors (CONEG) Source Reduction Council and activities to develop a risk assessment procedure to determine composition of product packaging. After extensive discussion, the Committee took the following actions: o endorsed a policy to include appropriate risk assessment, cost-benefit analysis and procedural safeguards in any activity to regulate or ban products or packaging; and o committed to review the risk assessment method being developed by the Society of the Plastics Industry as part of the CONEG Source Reduction Council Initiative. The novel nature of the risk method to assess packaging from time of sale to disposal was noted. The Risk Assessment Task Group has been briefed on the Council initiative and will work with the State Affairs Committee to review the method when it is developed. Engelman briefed the Committee on ATSDR's recently announced draft Health Assessment Guidance Manual and asked that the Committee approve expenditure of $29,000 to hire a consultant to develop comments on the manual and compare it with EPA's Risk Assessment Guidance for Superfund. The Committee approved the expenditure. 11. Environmental Illness P. Lewis discussed issues surrounding environmental illness and asked that the Committee approve the purpose and agenda for a joint CMA/API forum on environmental illness. The Committee approved the request. 12. TSCA S. Conti summarized CMA activities to address reporting and compliance concerns on TSCA Section 8(e) and reviewed recommended options for further CMA advocacy on the issue. Following extensive discussion, the Committee modified the recommendations for further advocacy as follows: o CMA will aggressively advocate prospective application of new EPA interpretations of TSCA Section 8(e) and improved processes for communicating clear guidance to industry through active participation in EPA's internal work groups; o CMA will work to clarify TSCA 8(e) reporting requirements using the TSCA 8(d) CMA/EPA negotiation approaches as a model; and o CMA will closely examine all upcoming individual enforcement and related actions on TSCA 6(e) compliance by the Agency. The Committee approved the revised recommendation with one negative vote. 13. 1991 Ccwittee Planning Meeting The Committee agreed to reschedule the 1991 planning meeting to May 13-15, 1991. The meeting will be held at Kingsmill, Virginia. 14- IW Dr. Irv Rosenthal and Bill Carr joined the Committee and reviewed their efforts to redraft and revise the draft ILO Code of Practice on Major Accidents. The Committee approved the redrafted document. Dr. Rosenthal will distribute the document to the U.S. government and labor representatives, as well as the other industry representatives to a October 8-12, 1990, ILO experts meeting on the code in advance of the meeting. CMA 061052 HSC Meeting Minutes September 26, 1990 Page 5 15. OECD S. Tirey reported on the September 17, 1990, Conservation Foundation Forum to review the 9 U.S. OECD SIDS dossiers. The dossiers are undergoing minor revisions following the forum and will be submitted to EPA by the end of September 1990. The dossiers of the other participating OECD countries will be reviewed by interested U.S. parties at the end of October 1990. Issues identified during the Forum include: o testing difficulties with highly reactive chemicals; o route of exposure for repeat dose studies; o guidance needed on how to characterize use, production, and exposure in the dossiers; o need to improve data exchange among OECD countries; and o guidance on when terrestrial ecotoxicity should be included in testing plans. The Forum participants suggested a decision logic be developed for terrestrial ecotoxicity testing considerations and an international board established to address mutual acceptance of data. 16. Epidemiology S. Engelman briefed the group on the Guidelines for Good Epidemiology Practice for Occupational and Environmental Epidemiological Research and asked that the Committee approve the guidelines. The Committee approved the request, 17. OSHA J. Price briefed the Committee on the status of the John Gray Institute Study on contractor health and safety practices in the petrochemical industry and the activities of the Ad Hoc Work Group. 18. Indoor Air Quality D. Sigman presented recommendations of the Risk Focus Area for CMA advocacy on indoor air quality regulations, legislation and scientific issues. He asked that each focus area leader discuss relevant issues and report back to the Committee in 1-2 months. The Committee agreed. 19. Ripnimra Amiggsnent M. Friedman reported that the request for funds to develop protocols for combining databases on exposure to chemicals will be tabled pending further effort by the task group to define the project. CMA 061053 HSC Meeting Minutes September 26, 1990 Page 6 20. Sponsor Reports L. Smith reported that 130 people attended the September 11, 1990, Product Stewardship Code open meeting. The next open meeting to review the draft code is tentatively scheduled for December 4, 1990, in Houston. He also updated the Committee on the Product Safety Task Group's activities to develop a MSDS access policy, work with 0SHA and ORC on a MSDS repository, meeting with government agencies (including 0MB) on CMAs MSDS Guideline, international hazard communication, and environmental labeling. W. Dyste reported on activities of the CAER Task Group noting a November 1, 1990, workshop on community dialogue and outreach, release of the CAER Resource Disk and selection of a contractor to develop a crisis management manual. J. Price reported that 300 people were registered for the Living with TSCA Seminar on October 2-4, 1990. The Chemical Reporting Task Group will also be meeting with EPA on September 12, 1990, to discuss polymers. H. Lockhart reported that the Scientific Issues Task Group selected biomarkers as the first priority issue to address. N. Neunaber reported on the Existing Chemical Testing Task Group meetings with Gary Timm/EPA and Deborah Barsotti/ATSDR. P. Lewis informed the group of the October Health Programs planning meeting. He also noted that the Industrial Hygiene Issues Task Group needs a chairman and that the MEDTREC Work Group will be requesting funds to pay travel expenses for poison control center personnel involved in the MEDTREC to attend a CMA meeting. E. Currie briefed the Committee on a September 20, 1990, meeting with EPA on their developing product stewardship regulation.
