Implementation of these directives could require new starts in certain areas. For example, to carry out the SO addressing the National Energy Emergency DOI is working to identify authorities and may need to initiate new starts to accelerate the identification, permitting, leasing, development, production, transportation, refining, distribution, exporting, and generation of domestic energy resources and critical minerals. We worked with Solicitor to draft the following language for your consideration: Sec. 104. (a) Subject to subsection (b), no appropriation or funds made available or authority granted pursuant to section 101 shall be used to initiate or resume any project or activity for which appropriations, funds, or other authority were not available during fiscal year 2024. (b) This section shall not apply to appropriations or funds made available pursuant to section 101 for construction accounts within the Department of the Interior, or to amounts necessary to implement Presidential directives.
