The Department wants to ensure there are no barriers to implementing Presidential and Secretarial directives during the CR and we are still developing our implementation plans. Implementation of these directives could require new starts in certain areas. For example, to carry out the SO addressing the National Energy Emergency DOI is working to identify authorities and may need to initiate new starts to accelerate the identification, permitting, leasing, development, production, transportation, refining, distribution, exporting, and generation of domestic energy resources and critical minerals.

Thanks. Can you provide a bit more explanation for why SO/PD are considered new starts? We have a very high bar for we need as much info as we can to potentially argue for inclusion.

Hi Kristin - we would need language to lift that prohibition for construction accounts and appropriations necessary to carry out Presidential directives. We worked with Solicitor to draft the following language for your consideration:
Sec. 104. (a) Subject to subsection (b), no appropriation or funds made available or authority granted pursuant to section 101 shall be used to initiate or resume any project or activity for which appropriations, funds, or other authority were not available during fiscal year 2024. (b) This section shall not apply to appropriations or funds made available pursuant to section 101 for construction accounts within the Department of the Interior, or to amounts necessary to implement Presidential directives.

We (House and Senate Republicans) are working on a tight turnaround for some general CR language related to new starts. If we include language prohibiting new starts (i.e., no project or activity for which approps were not available during FY24), are there any must have exemptions/new language DOI would need?
