R. 10085 IN THE HOUSE OF REPRESENTATIVES Jui-y 20,1971 Mr. IIyan introduced the following i>il1; which was referred to the Com mittee on Intel-state and Foreign Commerce A BILL To prohibit the introduction or delivery for introduction into commerce of the chemicnl compound known us polyehlorinated binhcnvl. 1 Be it enacted by the Senate and House of Representa2 fives of the United States of America in Congress assembled, 3 That for the purposes of this Act-- 4 (1) The term "commerce" means commerce between 5 any State and to or through any place outside thereof; or 6 within any territory or possession of the United States or the 7 District of Columbia; or from a foreign'country to any 'Stale. 8 (2) The term "State" means each of the several Stall s, 9 the District of Columbia, the Commonwealth of Pneilo Rico, I' 00*' TOWOLDMONOOQ3945 2 1 tbe Virgin Islands, American Samoa, Guam, (lie Canal Zone, 2 and the Trust Territory of the Pacific Islands. 3 (3) The term "person" means any private person or 4 entity, any officer, department, agency, or instrumentality of 5 any State or local unit of government, and any officer, depart 6 ment, agency, or instrumentality of the Pcderal Government. 7 Sec. 2. It shall he unlawful for any person to intro 8 duce or deliver for introduction into commerce any of the 9 chemical compound known as polychlorinated biphenyl. 10 Sec. 3. (a) Any person who knowingly violates sec 11 tion 2 of this Act shall be fined not more than $5,000 or 12 be imprisoned not more than one hundred and eighty days, 13 or both. 14 : (b) Whenever any corporation knowingly violates sec 15 tion 2 of this Act, such corporation, and any individual 16 director, officer, or agent of such corporation who know 17 ingly or willfully authorized, ordered, or performed any of 18 the acts or practices constituting such violation shall be fined 19 not more than $5,000 or imprisoned not more than one 20 hundred and eighty days, or both. 21 Sec. 4.
