I have tasked the Office of Indian Gaming (OIG) with conducting additional analysis to clarify inconsistencies between the views expressed by the opposing parties involved. I am expecting a response from OIG next week. Contrary to the quote in your letter, DOI has not made a decision on this matter. I often use the Shawnee case as both an illustration of the additional consideration DOI gives to landless Tribes and the conflicts involved in addressing applications seeking to place land into trust a long distance from where tribal members live. With the recent addition of our new Deputy Secretary, it has become less clear about who would sign a decision document. I have briefed the Secretary on this matter several times. I will bring David Bernhardt, our new Deputy Secretary, up to speed shortly. Once I have the results of the OIG analysis. I plan to share the information with both the Secretary & Deputy Secretary to obtain their direction for deciding this matter. At this point, I am anticipating a decision sometime later this month.
