Plaintiff, a mail carrier, was soaked with a Chemlawn product containing dursban insecticide, manufactured by the DOW Chemical Company. Apparently, Chemlawn initially concealed the presence of dursban in its product. Moreover, Chemlawn conceded liability at trial. Dow was not a defendant. Perhaps the most interesting aspect of this case is that Dr. Paula Davey testified as one of plaintiff's expert witnesses.
