Section I - INTRODUCTION

PURPOSE OF THE INSPECTION
EPA Region 6 inspector David Esparza, PE, arrived at the City of Bloomfield Wastewater Treatment Plant (WWTP) (Bloomfield) at approximately 9:00 AM on August 30, 2023, for an unannounced inspection. I met with Mr. David Sonnenberg, Water Reclamation Superintendent. I presented my credentials and informed him that this was an EPA inspection to determine the WWTP's compliance under the Clean Water Act (CWA). This CEI was conducted under the authority of the National Pollutant Discharge Elimination System (NPDES) permit program, in accordance with the CWA. The generation of this report is based on information supplied by Bloomfield representatives, observations made by the United States Environmental Protection Agency (US EPA) inspector, and records and reports maintained by the permittee (Bloomfield) and the US EPA. Before leaving the facility, an exit briefing was held with Mr. Sonnenberg, to explain areas of concern noted at the time of the inspection.
FACILITY DESCRIPTION
The WWTP is a major discharger, with a design flow of 0.9 million gallons per day (MGD), and is located at 1176 S. Church Street, Bloomfield, San Juan County New Mexico (depicted in Aerial Image #1 below). The WWTP serves a population of approximately 7,800 residents. The WWTP is operated by staff within the Public Works Department and consists of 5 full-time equivalent (FTE) positions, inclusive of administrative support on a Monday through Friday 8-hour per day basis. On-call staff is available on an as needed basis.
The head works located at the entry to the WWTP has split channels: a manual bar screen, and a mechanical grit and solids removal system inclusive of a screw pump. These split channels converge at an aerated grit chamber, thence to three (3) sump pumps that lift the influent water to the recently constructed sequencing batch reactors (SBR) and digester basins. The previous digester basins (#1 through #4), aeration basins (#1 and #2) and south clarifier are currently offline. The previous north clarifier is projected for future toxic flow storage. The previous chlorine contact chamber (CCC) has also been replaced and/or upgraded by a newly constructed chamber. Additionally, other treatment processes within the existing WWTP are currently undergoing rehabilitation and/or upgrades (depicted in Aerial Image #2 below).
The city maintains 2 lift stations (Identified in Table 1 below).

Decant from the digester is returned to the head works where it mixes with the raw influent. From the digester, solids are sent to the belt press, thence to the sludge drying beds. The sludge drying beds have under drains that direct liquids back to the head of the plant. Grit removed from the head works is collected in a hopper and disposed of at the landfill. Final disposal of solids is to a surface disposal site at the WCA Bondad Landfill in Durango, Colorado (County Road 318, Durango, CO 81303 (970) 2478295). Currently the only established Industrial User (IU) is Enterprise Field Services, LLC (Enterprise). Bloomfield and Enterprise entered into a wastewater treatment agreement for the disposal of their wastewater into the City's WWTP on May 1, 2022, with an expiration date of April 30, 2025 (Appendix 4 City of Bloomfield and Enterprise Field Services, LLC Wastewater Treatment Agreement). Contingency/Emergency Operations The WWTP rehabilitation included installation of a new back-up generator in the event of an electrical power disruption or unit failure, for the entire plant and the onsite lift Station. Additionally, there is a new supervisory control and data acquisition (SCADA) and call-out system.

Section II - OBSERVATIONS

The following discussion will address current activities associated with the scheduled rehabilitation and/or new construction identified in Administrative Order (AO) Docket Number CWA-06.2019-1778.
Aeration Basins - The two (2) existing parallel aeration basins recommended for replacement in the February 2018 Preliminary Engineering Report (PER) have been replaced with new Sequencing Batch Reactor (SBR) basins, inclusive of other improvements (Appendix 2 Project Site Map). These newly constructed SBR basins are denoted in red in the upper portion of Aerial Image #2 and required the removal of several existing drying beds. Additionally, the new SBR basins will utilize air diffusion rather than the previous paddle type for mixing.
The existing north side clarifer will be rehabilitated and used as a future toxic flow storage basin, while repair/rehabilitation to the south side clarifier was deemed not cost effective and will ultimately be demolished.
The existing chlorine contact chamber (CCC) has been replaced with a larger CCC denoted in red in the lower center of Aerial Image #2.
Bloomfield does have existing written Standard Operating Procedures (SOPs) and is in the process of updating these documents to reflect the rehabilitated WWTP and treatment processes. Furthermore, the facility is in the process of preparing written policies and procedures to address potential sanitary sewer overflow events (SSOs) and evaluating a Fats, Oils and Grease (FOG) policy.
A Certificate of Substantial Completion was issued March 16, 2023. This certificate additionally identifies "Final Punch List" items remaining to be addressed prior to commissioning (Appendix 5 Certificate of Substantial Completion and Final Punch List).
The overall housekeeping of the WWTP of the grounds and ancillary appurtenances appeared to be well maintained and in operational order.
The WWTP did have secure perimeter fencing and lighting; thus, limiting access.
Section III - AREAS OF CONCERN
The following areas of concern (AOCs) were observed and discussed with the City of Bloomfield:
A review of the submitted Integrated Compliance Information System (ICIS) Discharge Monitoring Reports (DMR) data for the period March 31, 2022, through April 30, 2023, indicates numerous NPDES permit excursions with respect to Chlorine, total residual (Appendix 3 ICIS E90 Effluent Violations).

WASTEWATER TREATMENT AGREEMENT

ARTICLE I
EFFECTIVE DATES

SECTION 2.5 "Parties" means Enterprise and the City.

"Wastewater" means the combined streams of all wastewater discharged from the Blanco Plant to the City Wastewater Treatment System. The
streams to be combined included Cooling Tower Blow Down, Boiler Blow Down, Domestic Wastewater, Storm Water, and Wash Water.
SEC ON 2.10
"Wastewater Treatment" means the receipt, treatment, and proper discharge oftreated wastewater by the City Wastewater Treatment System, in accordance with all applicable laws, regulations, and permits.
SECT-ION 2.11 .
"Wastewater Treatment System" means the piping and treatment equipment operated by the City for the receipt, treatment, and discharge of municipal and industrial wastewater.
ARTICLEm PERFORMANCE
SECTI N 3. I
The City shall provide Wastewater Treatment for Enterprise's Wastewater from the Blanco Plant.
SECTION 3.2
Enterprise shall discharge Wastewater to the City in accordance with the quality limitations listed in Exhibit A, except as otherwise provided herein. Enterprise shall meet the total dissolved solids ("IDS") limit of 600 mg/I so long as such limit does not cause the City to exceed limits set by the Environmental Protection Agency ("EPA") for Publicly Owned Treatment Works ("POTW") or cause th~ City not to comply with the Colorado River Basin Salinity Control Act (Public Law 92-32, JW1e 24, 1974). In the event the City no longer complies with the POTW limits or the Colorado River Basin Salinity Control Act and F.nterp~'s IDS discharge is 600 mg/I, the City will immediately notify F.nterprise of its reasonable requirements to appropriately reduce the Enterprise TDS limit for that period of time necessary to bring the City into compliance with all relevant Jaws. Enterprise will be afforded a reasonable time to implement such reduction, but in no event will such time exceed the time allotted to the City to come into compliance.
SECTION 3.3
Enterprise shall provide analytical testing of Wastewater discharged totbc City from the Blanco Plant, in accordance with the list oftests, and at such frequency, as shown in Exhibit A, and will bear all costs related to such analyses.
SECTION 3.4
The City, at the City Wastewater Treatment System Superintendent's discretion, will collect a 24-hour time proportional sample of the water discharged from the Blanco Plant to the Wastewater Treatment System and will analyze the water and bear all costs related to such analyses.

SECTION 4.1 SEC ON 4.2
SECTION 5.1
Enterprise shall maintain in good working order the effluent flow meter installed by Enterprise at the Blanco Plant for use by the City in detemtining the quantity of Wastewater discharged to the Wastewater Treatment System. Enterprise shall provide the City with a secure realtime web-based access to flow meter readings, with historic trending, through an application of Enterprise's choice.
ARTICLE IV REPORTING
Enterprise shall provide the results ofanalyses performed under Section 3.3 herein to the City within 10 days oftheir receipt by Enterprise. Enterprise shall report all test results to the City at the intervals described in Exhibit A.
Enterprise shall orally report any upset, abnormal operati_on, emergency, or any violation ofthe daily maximum limitations for any pollutants listed in Exhibit A, within 24 hours. A written report wili be provided to the City within five days to the City of Bloom.field Wastewater Superintendent. Further, Enterprise shall report any change in its discharge (including the introduction of any new source or significant change in the quantity or quality ofexisting discharge of poJlutants). In no case are any significant changes pennitted that will cause vio1ation ofthe effluent limitations specified herein.
ARTICLEV COST REIMBURSEMENT
Enterprise will pay industrial user rates for Wastewater Treatment. The industrial user rates mandated in the City Code ofthe City ofBloomfield (and as amended from time to time), require that Enterprise pay $103.30 per month as a base rate and $4.73 per 1,000 gallons of Wastewater discharged into the Wastewater Treatment System. Quantities o~ Wastewater will be measured by a flow meter installed according to Section 3.5 above.
In addition, the following charges will apply:
$2.50 per month Capita] Replacement Charge pursuant to Ordinance 475.
$3.25 per 1,000 gallons of Wastewater for A Capital Replacement Charge pursuant to Ordinance 482.

Enterprise and the City shall review the monthly rate being charged on an annual basis, in the event ofa City-wide rate adjustment. At such time, upon review, the Parties may change the rate through written mutual agreement. If, upon review, the Parties cannot agree upon the monthly rate to be charged, either Party may terminate this Agreement to be effective on 30 days' written notice to the other Party.
ARTICLE VI DAMAGES
In the event Enterprise discharges any substance or material not pennitted by the tenns of this Agreement, which results in an adverse impact upon the operation ofthe Wastewater Treatment System, Enterprise shall promptly pay the City all actual damages incurred by the City as a direct result of said discharge.
ARTICLEVIl INSPECTION, MONITORING, AND ENTRY BY THE CITY
Enterprise shall comply with the City Code ofthe City (including any amendments thereto that may be passed from time to time). in allowing the City to inspect and monitor Enterprise Wastewater discharge, provided that all entries by the City on Enterprise property will be limited to inspection and monitoring ofEnterprise Wastewater equipment at the Blanco Plant Due to the nature of the gas transmission business and the de.sire to reduce unnecessary risk to any ofthe City's authoriud representative, all on-site inspectors must adhere to Enterprise safety procedures in effect at the Blanco Plant. Except in the event of an emergency or for routine discharge sampling, all on-site inspectors must be accompanied by an Enterprise representative.
ARTICLEVIlI ATrORNEY'S FEES
In the event either Party (the "Non-Defaulting Party'') incurs attorney's fees or costs to enforce the tenns ofthis Agreement or attorney' s fees, costs, fines, or penalties as a result of
a third-party action due to the other Party's non-compliance with the: terms ofthis
Agreement, the Non'."Defaulting Party will be paid the reasonable attorney's fees, costs, fines, and penalties incurred by the other Party.

ARTICLE IX ASSIGNEMENT
Neither Party may assign this Agreement without prior written consent ofthe other Party. Neither Party shall unreasonably withhold its consent to the assignment ofthe Agreement.
ARTICLEX GOVJ;RNING LAW
All provisions ofthis Agreement will be governed by and construed in accordance with applicable federal law and Regulations and the laws and regulations ofthe State ofNew Mexico, excluding any conflict oflaw, rule, or principle that might apply the laws of another jurisdiction. Each Party is responsible for abiding by all such laws and regulations applicable to its operations.
ARTICLE XI MISCELLANEOUS PROVISIONS
SECTION 11.1 The Section headings contained in this Agreement are for the convenience of the Parties only and wilJ not be interpreted as part ofthis Agreement.
S CTION 11.2 This Agreement may only be modified by a written instrument mutually executed by a duly authoriz.ed representative of the respective Parties.
SECTION 11.3
Waiver by one Party ofthe other's b~h of any provision ofthis Agreement must be in writing and will not be deemed a waiver ofany subsequent or continuing breach of such provision or ofthe breach of any other provision ofprovisions ofthis Agreement.
SECTION 11.4 This Agreement may be renewed or extended upon the mutual agreement of both Parties.
