M ost o f these points have been reported in a stunt PROFS note following R. Perkins' and the undersigned's visit to the H oechst Hattersheim Center close to Frankfurt, late June `96. dd / lettera'dyivn/X012 -13M MN03591099 12/12/96 09:14 PCF EBU - LE DIX.U.RKEN.UOUTERS -> 97331773 NO.051 002 L CAS numbers : This request from D y n e o n goes as far back as June this year, when Dyneon w as still H oechst That tim e w e were requested by H oechst to resolve the CAS numbers as mentioned on our M SDS. R. Cox has looked into this, but apparently not to a degree that i$ satisfactory to Dyneon. This request has been re activated by Dyneon. The problem : 3M 's M SDS contains several CAS numbers for several different products (C 7,C 8,C 9,..), BUT only one CAS number for the C8 material. This C8 CAS number stands for the linear material Dyneon is o f the opinion that the 3M M SDS is, therefore, inadequate due to the lack o f the CAS number for the branched isom er(s) and therefore may possibly violate an E U reporting guideline. A ction; R .C ox to co-ordinate either resulting in a change in our M SDS or an explanation to Dyneon that w e are in complete compliance with EU guidelines. T im ing: Bob, please communicate our timing to Dyneon, Dr. R. Sulzbaeh, copy to Dr. R. Jung and T. Le Due. Dr. R. Jung has studied both the DuPont and 3M studies. These studies report tumors in liver, testicels and pancreas o f the test animals at test dosis. Dr,R.Jung clarified that the liver and testical tumors could be explained and could lead to a class 3 classification, but that the pancreas tumor is rare and puts the class 3 classification on questionable grounds. H e has difficulty with the present 3M position (see fax R .C ox hereto attached) and would prefer a harmonized Dyneon-3M position with respect to labeling o f the C8 salt. H e is o f the opinion that 3M should ask a confirmation to the EU o f 3M 's intention to classify and label the product in the class 3 cancerogenic classification. D u s action needs to be initiated by 3M via a documented toxicological dossier supporting the class 3 classification. Elr. Jung informed me that in the U S, the product is in the A3 category (Am. Confi o f Industr. H yg.), which would / could be translated to a class 3. So far a synopsis o f a long tel-call with Dr. Jung. ild/kUos/dynom/lQU 2- 3M M N 03591100 12/12/96 09:14 PCF EBU - LE DUC.U.flKEN.WOUTERS 87331773 NO.051 003 I am out o f my depth to express a conviction or a belief on the tox, aspect o f this matter. However, w e also have to ask ourselves a few questions: D oes an R40 label for C8 damage the market place at all ? (W e are selling to D u P ont's, ICI... .I assume these companies can handle class 3 chemicals, or does this have an effect on som e o f their PTFE dispersion grades labeling ? Direct food contact applications ?). D oes an R 40 label raise other questions in the domain o f eco toxicity (bioaccummulation, long half lifetime )? If, the answer to those questions is negative, why not just go for an R 40 la b e l?
