Regulation 247 (Harmful Exposure), "Regulations for the
Prevention and Control of Diseases Resulting from Exposure to
Toxic Fumes, Vapors, Mists, Gases and Dusts in Order To
Preserve and Protect the Public Health," Legal Requirements for
the Prevention and Control of Industrial Public Health Hazards,
Division of Industrial Hygiene, Ohio Department of Health, 1946
(Adopted by the Ohio Public Health Council February 16, 1946.
Filed with the Secretary of State, March 1, 1946. Effective
January 1, 1947)(This Ohio State Regulation effectively puts
Goodyeaer on notice as of 1947 regarding the dangers of asbestos.
It states in pertinent part: "(2) The concentration of dusts,
fumes, mists, vapors, or gases, in the air breathed by employees
shall not exceed the following maximum allowable
concentrations for an 8-hour daily exposure: .....MINERAL
DUSTS, Asbestos, 5 Million particles per cubic foot." hi the
"Explanatory Note" section at the bottom it is made clear that
asbestos monitoring is to be accomplished in a professional
manner: "(2) The sampling and analysis of contaminated air
and the interpretation of the data in relation to the stated
maximum allowable concentrations shall be done only by
technically qualified and competent persons using methods
approved by the Ohio Department of Health.")(emphasis
added).

Letter, In Re: The Goodyear Tire & Rubber Co., visit of Division
of Safety and Health, 5/4/48 (page 3 describes asbestos found in
sampling of sand debris: "Men are required to go into this
collector after it is shut down and shovel the fne asbestos dust
from the floor inside the collector into trucks. They do not
wear respirators. This is a definite asbestos hazard and should be eliminated. No man should be allowed to go into any type dust collector when cleaning if they are not supplied with approved Bureau of Mines dust respirators. Men are required to shovel asbestos from trucks into the mixers and again inhale some of the dust. The writer was informed that within a few months this operation may be changed to automatic filling. There are exhaust systems on the mixers but the shoveling operation causes the exposure")(emphasis added).

Letter, In Re: Claim of Ruth F. Griffin, From: State of Ohio, The
Industrial Commission of Ohio, Division of Safety and Hygiene,
10/6/75 (asbestos exposure due to brake manufacture: "On July
30, 1975, a visit was made to the B.F. Goodrich Company, 500 S.
Main St., Akron, Ohio to check conditions under which the
claimant had worked.....The claimant did not wear a respirator and
as far as known did not have one readily available. The company
stated that special asbestos mat fabric sheath coverings were used
for brake `boot' tubes for earth moving equipment.. .to eliminate
brake friction heat and prevent cracking of rubber. This began in
1959-60. The claimant last worked this department in 1956.
Asbestos was not used elsewhere. Although not positive, the
claimant believes she has worked with asbestos fabric.....Working
with brake shoes, which contain bonded asbestos.. .as previously
described certainly may entail an asbestos exposure. Acute heavy
exposures were improbable as air hoses, grinding, or buffing
operations were not known to be in the vincinity. However, the
claimant may have been exposed to a consistent low
concentration...for over 7 years. Asbestos is a remarkably
toxic substance causing a pulmonary fibrosis, asbestosis. One
or several acute exposures are thought to be enough to bring
about the disease, of which the symptoms and promulgation
may lay dormant for years." (emphasis added).

Letter, From: Manager, Corporate Industrial Hygiene, To: P.J. Brown, 1/3/77 (This letter alludes to the PHASE-OUT of asbestos: "As you are aware, there has been constant activity by OSHA and NIOSH over the part of several years to continue reduction of personnel exposure to asbestos.....Implications of this trend are obvious, i.e. future uses of asbestos and asbestos containing materials will become so restricted as to makes its' application infeasible. Substitute materials must be utilized to replace asbestos.")(emphasis added).

Report goes on to describe Selikoff s study. No evidence exists that Goodyear had ever disavowed in any manner this report prepared for, reviewed by, and presumably approved and disseminated by the Goodyear Health Committee and Goodyear)(emphasis added).
