Enclosed please find a copy of an information request, issued by the EPA pursuant to Section 3007(a) of RCRA, 42 U.S.C. 6927(a) in the above-referenced matter, which requires MPS to produce certain information and documents. Please note that the enclosed information request requires MPS to respond to EPA Headquarters within 30 days of receipt and to produce on that date all information and documents specified in the request. Files claimed as Confidential Business Information must be submitted according to the instructions in Section V of the information request. This letter and enclosed information request serve as notice to MPS to retain its RCRA records pursuant to 40 C.F.R. 264.74(b). This information request is not subject to the approval requirements of the Paperwork Reduction Act of 1980, 44 U.S.C. 3501, et seq. Compliance with this request is mandatory. Failure to respond fully and truthfully, or to adequately justify such failure to respond may result in an enforcement action pursuant to Section 3008 of RCRA, 42 U.S.C. 6928.
