This inspection report may also include information gathered from a review of EPA and/or public records. SECTION I - INTRODUCTION Facility Description The Dworshak National Fish Hatchery (hereinafter referred to as the "Facility") is a mitigation hatchery located at the confluence of the North Fork and mainstem of the Clearwater River, 3 miles west of Orofino, Idaho. The Facility was constructed in 1969, as is part of the Dworshak Fisheries Complex, which includes the Dworshak and Kooskia National Fish Hatcheries, and the Idaho Fish and Wildlife Conservation Office. The Facility footprint is within the Nez Perce Reservation of the Nez Perce Tribe of Indians. The Facility produces Steelhead trout, Chinook Salmon, and Coho salmon to mitigate for habitat lost due to the construction of the Dworshak Dam lower Snake River dams. In 2023, the Facility reported production values of 450,010 pounds. The Facility is owned by the U.S. Army Corps of Engineers (USACE) and currently operated by the Nez Perce Tribe. There are currently 25 employees, including 5 maintenance staff and 5 administration staff. The Facility includes 65 Burrows ponds, 2 mixed-call rearing units, and 30 raceways for rearing summer Steelhead trout, Spring Chinook, and Coho Salmon. Four ponds are utilized for holding adult brood stock. There are four circular tanks located adjacent to the off-line settling basin (OLSB) that are used to hold and re-condition adult steelhead after spawning. Juvenile rearing facilities include 124 nursery tanks and 116 vertical incubation stacks with 1,740 trays. Influent sources at the Facility include both reservior water and river water. Reservior water is brought to the Facility from two supply lines (two depths) within the Dworshak Reservior. The primary supply line can be adjusted within the reservior to allow warmer water to be selected. Reservoir water is generally used from May - July. River water is pumped to the North Fork Clearwater River. Effluent sources from the Facility include discharges from operations that come in direct contact with fish, storm water, condensation from non-contact cooling systems, and/or influent (raw) water overflow. Discharges from these effluent sources are routed to the North Fork Clearwater River via Outfall 001 and Outfall 002, as well as to the mainstem of the Clearwater River via Outfall 003 and Outfall 004. Depending on upon operating conditions, discharges may flow continuously, intermittently, or have no flow. Permit Information The Facility is permitted under EPA's NPDES General Permit for Aquaculture Facilities Located in Indian Country (IDG133000), with the assigned tracking number IDG133001. The Permit authorizes the discharge of pollutants resulting from the Facility's operation, processes, and waste streams to both the North Fork and mainstem of the Clearwater River. The current Permit became effective on December 1, 2019, and is set to expire on November 30, 2024. On May 22, 2024, the facility submitted a timely, renewed Notice of Intent (NOI) which was deemed complete by EPA on May 23, 2024. Coverage under the existing permit will remain effective and enforceable until EPA grants or denies an NOI for coverage under a new permit. See Attachment A, 2024 NOI, and Attachment B, Reauthorization Letter. Monitoring parameters required include Total Suspended Solids (TSS), Total Phosphorus, Flow and Total Residual Chlorine (as applicable). Page 2 of 32 Inspection/Compliance History 2024 IDG13301 CWA NPDES Inspection Report According to EPA records, there has been no recent compliance inspection activity. Entry and Inspection Chronology This was an announced inspection. On July 23, 2024, I spoke with Mr. Jeremy Sommer, Hatchery Manager with the Dworshak National Fish Hatchery. During the phone call, I discussed that I had been asked to conduct an onsite Clean Water Act inspection at the Facility to assess compliance with the EPA-issued NPDES Aquaculture Permit #IDG133000. Mr. Sommer welcomed the inspection and we agreed on an inspection date of July 30, 2024. To assist in coordinating with others as needed, I followed up with an email to Mr. Sommer outlining the purpose and expectations of the inspection. On the day of the inspection, I arrived at the main visitor center at the Dworshak National Fish Hatchery at approximately 1:30PM. I was greeted by Mr. Sommer as well Mr. Matthew (Matt) Carlock, who representing the USACE. We were then joined by Ms. Lautiss Shebala, Assistant Hatchery Manager for the Dworshak National Fish Hatchery. This inspection consisted of an opening conference, Facility walk-through, records review, and concluded with a closing conference. For the opening conference, we had initial introductions, I presented my EPA inspector credentials and restated the purpose and scope of the inspection. Mr. Sommer and Ms. Shebala then provided a brief background on operations and management responsibilities. The opening conference was held within a conference room area on the 2nd floor of the visitor center/office building. Following the opening conference, we were joined by Mr. Casey Sweeney, who was also representing the USACE. We had initial introductions and I recapped portions of the opening conference to Mr. Sweeney, and we continued with the walk-through. During the walk-through we observed the various Facility components and waste streams, including the river intake structure, ponds, rearing units, fish ladder, raceways, clarifiers, offline settling basin (OLSB), filter beds, nursey area, storm drains, material/chemical storage areas and outfalls. During the closing conference I discussed my observations, potential compliance concerns and next steps, including the inspection report and compliance review process. I was accompanied throughout the inspection by Mr. Sommer and Mr. Carlock. Ms. Shebala was present only for the opening conference; Mr. Sweeney was present for the Facility walk-through and closing conference. Photographs taken during the inspection are attached to this inspection report as Attachment C, Photograph Log. SECTION II - OBSERVATIONS Site Review At the time of inspection, the Facility was holding Spring Chinook and Coho Salmon and Steelhead trout. Spring Chinook occupied approximately 17 of the 30 raceways, 13 ponds were occupied with Steelhead trout and 5-6 ponds were occupied with Coho Salmon. A portion of the Facility was under active construction as the steelhead release pipe (Outfall 004) was being replaced along the mainstem Clearwater River. The release pipe was previously corrugated and was being replaced with a smooth concrete piping. The Facility's ponds holding facilities are separated into three separate systems (System I, System II, System III). Mr. Sommer discussed the Facility's design via a conveyance map posted on the wall of his office (Photo 1). Page 3 of 32 2024 IDG13301 CWA NPDES Inspection Report System I consists of 25 burrow ponds with a maximum influent flow rate of 20,500 gallons per minute (gpm). Two standpipes allow water to be routed to eight possible clarifier cells within System I (discharging to the North Fork Clearwater River via Outfall 001) or discharge directly to the Clearwater River via Outfall 004. Six of the eight clarifier cells are generally for the outside rearing units, the other two clarifer cells are utilized for the indoor nursery. Each clarifier is 75 feet long, 22 feet wide and 6 feet deep. An Envirex chain and scraper sludge collector with a screw-type cross collector for drawing off sludge is installed in each clarifier. Sludge is directed to one of two digesters. Removed solids are transported to the drying beds located adjacent to the OLSB. Solids are hauled to the local landfill approximately every 10 years. Pond cleaning occurs by manually sweeping the ponds, a mechanical scrubber is be used between rearing cycles and after the fish in the unit have been released. Cleaning is conducted one to five days per week. After sweeping, the pond flushes until the discharge water runs clean. System II consists of 25 burrow ponds with a maximum flow rate of 21,500 gpm. Two sandpipes allow water to be discharged to the Clearwater River via Outfall 004, or to the North Fork Clearwater River via the ladder and attraction channel (Outfall 002). There are four bio-filters utilized in System II as clarifiers/settling basins. An automated system is utilized to pump off the supernatant to discharge to Outfall 002 each evening to allow for cleaning the following day. Concentrated sludge/sludge solids from the clarifiers/settling basins are pumped to the OLSB and eventually to the adjacent drying beds. Cleaning is conducted similar to System I. During recent operations, System III is rarely used for fish holding; however, due to the release pipe construction project, System III was holding fish normally contained within System II at the time of inspection. System III consists of 34 burrow ponds with a maximum flow rate of 29,000 gpm. The system is operated on single pass river water pumped from the North Fork Clearwater River. System III ponds have one standpipe that directs flow through water to the Clearwater River via Outfall 004 or to the North Fork Clearwater River via the ladder and attraction channel (Outfall 002). There are six bio-filters utilized in System III as clarifiers/settling basins. Like System II, an automated system is utilized to pump off the supernatant to discharge to Outfall 002 each evening to allow for cleaning the following day. Cleaning waste is transported to the System III clarifiers/settling basins prior to discharging to the OLSB and eventually to the adjacent drying beds. Cleaning of System III is conducted similar to System I and System II. The Facility's raceway system consists of 30, 8' x 80' raceways operating in a single-pass or reuse configuration depending on the state of fish rearing. Flow-through water is discharged into the North Fork Clearwater River via Outfall 002. Standpipe plates are used on two raceways and mud valves are used on the other 28 raceways. Cleaning waste is routed to the OLSB via sump pumps. The Facility's nursey system consists of 124 rectangular nursery tanks with a maximum flow rate of 4,500 gpm. The nursery operates generally late January or early February, through early September. The nursery operates on single-pass reservior water that may be heated. Flow enters one end of the tank and discharges out the opposite end. Wastewater is discharged to the nursery and System I clarifiers prior to being discharged to the North Fork Clearwater River via Outfall 001. The incubation room is operated from January through June for steelhead egg incubation, August through April for incubation of spring Chinook salmon eggs, and October through April for incubation Coho salmon eggs. There are 116 stacks of 16 trays, where cleaning wastes from the incubation room discharge into drains to a collection channel and directly into the North Fork Clearwater River. There are four adult holding ponds. Water from holding ponds, 1, 2, and 3 flows into the Facility's attraction channel, and discharge water from the 4th holding pond (holding pond 9) discharges to the ladder. The attraction channel and ladder converge and discharge to the North Fork of the Clearwater River via Outfall 002. Page 4 of 32 2024 IDG13301 CWA NPDES Inspection Report Chemicals used for Facility operations include AQUI-S 20E, Carbon Dioxide, Thloramine T, Chorine, Formalin, Ovadine, Ovaplant-L, Propoly Aqua/Kordon, Sodium Chloride, Sodium Thiosulfate, Virkon. Usage is reported annually within the annual reports. Walk-Through Observations: Location: Raw Water Intake & Northern Facility Areas Observation #: OB-001 We began the Facility walk-through as we left the main office building and walked to the northern portion of the Facility. We observed the source water intake structure from the Nork Fork Clearwater River (Photo 2). Mr. Sommer discussed that River water is pumped from the North Fork Clearwater River using six pumps rated at 11,500 gpm. Four pumps were being utilized at the time of inspection (approximately 46,000 gpm). It was discussed that water intake screens are inspected daily when in operation. The Facility was also receiving 10,500 gpm from the reservior, which would be concluded for the year in the coming week(s). Reservior water lines enter the Facility beneath the public parking lot on the northeast side of the Facility. We then observed/discussed the associated water treatment facility and backup generator associated with the raw water facilities. We continued west and observed the nursery head tank, digesters and clarifer units associated with System I and the nursery (Photo 3, Photo 4). We observed Outfall 001 discharging to the North Fork Clearwater River (Photo 5). Outfall 001 discharges effluent from the System I and nursery clarifiers. We continued southwest and observed the fish ladder and Outfall 002 (Photo 6, Photo 7). Mr. Sommer discussed the sampling location and procedure for Outfall 002, located along the walkway as Outfall 002 discharges to the North Fork Clearwater River (Photo 8). Outfall 002 can be utilized for the System II and System III Ponds including flow through water. Location: OLSB, Outfall 003, Outfall 4 & Southern Facility Areas Observation #: OB-002 We continued the tour to the southern portions of the Facility. Southwest of the fish ladder we observed the OLSB and sump pump wet well associated with the OLSB (Photo 9, Photo 10). Concentrated sludge/solids from the clarifiers are pumped to the OLSB as needed. Adjacent to the OLSB, the drying beds were also observed. Mr. Sommer discussed that solids from the drying beds were last removed approximately 10 years ago. We then travelled to Outfall 003, which was discharging at the time of inspection (Photo 11). The walk-through continued along the southern portion of the Facility as we observed the numerous overflow pipes along the bank of the mainstem Clearwater River (Photo 12). No discharge was observed from the overflow pipes. We continued east along the southern perimeter and Formalin/chemical storage area (Photo 13) and observed the construction project for the new steelhead release pipe/Outfall 004, including the sampling location for Outfall 004 (Photo 14 - Photo 16). The walk-through concluded after viewing the System II ponds (Photo 17) and stormwater areas/discharge near the laboratory building. SECTION III - Records Review The following records were reviewed as part of the inspection: Page 5 of 32 Record: Discharge Monitoring Reports (DMRs) & Monitoring Data Ref #: RR-001 2024 IDG13301 CWA NPDES Inspection Report As discussed earlier in this report, the Facility is subject to monitoring for Total Suspended Solids (TSS), Total Phosphorus, Flow and Total Residual Chlorine (as applicable). As outlined in the permit, monitoring frequency is based upon the harvestable production weight, which is quarterly for facilities with production of 100,000 - 500,0001 (lbs). Prior to the inspection, I reviewed monthly DMR's that were submitted over the past 5-years (July 2019 - June 2024). This was also completed by a review of an exceedance report generated by EPA's Integrated Compliance Information System (ICIS). The DMR review noted 6 occurances of total Phosphorus exceedances. Exceedances were reported for the months of November 2022, June 2023, August 2023, January 2024, and May 2024. Based upon the monthly averages reporting, the 6 occurances equate to 154 exceedances (Attachment D). At the time of inspection, it was discussed that influent/effluent samples for permit compliance are collected monthly. Composite samples include four grab samples, with no fewer than 30-min between each sample. Samples are generally collected by Ms. Shebala or Mr. Sommer and are stored on ice prior to be hand delivered to Anatek Laboratories, Inc. in Moscow, Idaho. The Facility maintains bench sheet sample data, chain-of-custody records, results of analyses, and the corresponding DMR for each monitoring event. Laboratory results including chain-of-custody documentation is also submitted to EPA with the corresponding DMR. As a subsample, months reviewed included July 2021, November 2022, November 2023, and April 2024. Record: Annual Reports, Chemical Usage Logs, Production Numbers, Non-Compliance Reports Ref #: RR-002 Prior to the inspection, I reviewed annual report submittals, including reports for 2023, 2022, 2021, and 2020. Annual reports were received prior to the due date and contained all the required elements including production information, BMP review certification, land application/irrigation information, non-compliance summary, chemical usage, and inspection schedule. During my review it was noted that the 2021 Annual Report included a non-compliance incident report that occurred on June 2, 2021. Due to operator error, cleaning waste was discharged from three System III burrow ponds through the "attraction channel" and into the North Fork Clearwater River without treatment. According to the non-compliance report (Attachment E), the discharge occurred for 45 minutes. In addition to being included in the annual report, the non-compliance report was submitted to EPA on June 6, 2021. On-site, the Facility maintains annual production/release records, mortality records, chemical storage/usage logs, Investigational New Animal Drug (INAD) records, OLSB waste removal records. Records management was discussed and reviewed at the time of inspection. Record: Best Management Practices (BMP) Plan, Quality Assurance Plan (QAP) Ref #: RR-003 At the time of the inspection, I requested to review the permit-required BMP Plan and QAP. Mr. Sommer provided me with a copy of each and the documents were reviewed post-inspection. The Facility's QAP was last updated/reviewed on January 17, 2024. The Facility's BMP Plan was current as of January 2024. The BMP Plan and QAP were well documented and met the minimum requirements outlined within the permit. Page 6 of 32 2024 IDG13301 CWA NPDES Inspection Report SECTION IV- SAMPLING ACTIVITIES AND ANALYTICAL RESULTS No sampling was conducted for this inspection. SECTION V - AREAS OF CONCERN The presentation of Area(s) of Concern (AOC) does not constitute a formal compliance determination or violation. The following AOC was identified during the inspection: AOC Reference #: AOC-001 Effluent Limit Exceedances Regulation and/or Permit Requirement: Section IV.1 of the permit states that "the Permittee must comply with the effluent limits in the tables at all times unless otherwise indicated, regardless of the frequency of monitoring or reporting required by other provisions in this permit." Table 2 states the requirements for facilities with annual harvest/production values of 100,000 - 500,000 lbs (with no applicable TMDL). Table 2 lists an average monthly limit of 0.10 mg/L for Net Total Phosphorus and a maximum daily limit of 0.16 mg/L for Total Phosphorus. As discussed earlier within this report, prior to the inspection, I reviewed monthly DMRs that were submitted over the past 5-years (July 2019 - June 2024). This was also completed by a review of an exceedance report generated by EPA's Integrated Compliance Information System (ICIS). The DMR review noted 6 occurances of total Phosphorus exceedances. Exceedances were reported for the months of November 2022, June 2023, August 2023, January 2024, and May 2024. Based upon the monthly averages reporting, the 6 occurances equate to 154 exceedances (Attachment D). AOC Reference #: AOC-002 June 2, 2021, Unanticipated Bypass to Outfall 002 Regulation and/or Permit Requirement: Section IX.F.3. of the permit discusses the prohibition of bypass. As discussed earlier in this report, on June 2, 2021, cleaning waste was discharged from System III burrow ponds without treatment (Attachment E). Reporting occurred as required by the permit. SECTION VI - CLOSING CONFERENCE Closing Conference Following the Facility walk-through and records review, a closing conference was held with Mr. Sommer, Mr. Carlock and Mr. Sweeney where I discussed my general observations and potential area of concerns. I then thanked everyone for their time and cooperation with the inspection and departed the Facility. The current general permit for Aquaculture Facilities Located in Indian Country in Idaho expires on November 30, 2024. According to 40 C.F.R. 122.28(b), a complete and timely NOI, to be covered in accordance with general permit requirements, fulfills the requirements for permit application for purposes of 40 C.F.R. 122.6, 122.21 and 122.26. Pursuant to 40 C.F.R. 122.21(d), permittees with currently effective permits, "shall submit a new application at least 180 days before the existing permit expires." The EPA received your NOI on May 22, 2024, which was at least 180 days prior to the expiration date; therefore, the NOI for renewal of coverage is timely. An NOI submitted to the EPA for coverage under a general NPDES permit is complete when the Director receives the NOI and any supplemental information which is completed to his or her satisfaction under 40 C.F.R. 122.28. We have completed our review of the NOI and have determined that it was complete as of May 23, 2024. Pursuant to 40 C.F.R. 122.6, your coverage under the existing permit will remain effective and enforceable until the EPA grants or denies your NOI for coverage under a new permit. The crew did not follow the Standard Operating Procedures (SOP) as outlined in the Best Management Practices document while performing this task. As a result, the cleaning waste discharged from System III through the "Attraction Channel" and into the North Fork Clearwater River without treatment resulting in noncompliance. Duration of this non-compliance discharge was 45 minutes (~11:00-11:45). Fish biomass in these three ponds is low given these fish were ponded approximately 1 month ago. Total cumulative daily feed is less than 50 pounds per day and therefore these fish are generating very little fecal waste. Additionally, the combined flow for the three burrows ponds being cleaned is only 3% of the total flow after combining with the water from the raceways, attraction channel and fish ladder before reaching the discharge point in the North Fork Clearwater River; therefore, the impact to the river is negligible based on the associated dilution factor. Managers and crew supervisors have been notified to ensure the crew clearly understands the SOP, that following the SOP is required, as well as the NPDES permit requirements. Additionally, the Dworshak National Fish Hatchery staff will offer and provide training for this crew as needed.
