Previous Enforcement Actions: 2018 Expedited Settlement Agreement (CWA-01-CWA-01-2018-0031) for $ 6,900 penalty. III. Type and Purpose of Inspection Evaluation. Inspection is the result of a citizen complaint received by EPA. IV. Facility Description The site is a residential development, lying northwest of Chocolog Road, just west of Chestnut Street. On the west side of the entrance, there lies a detention basin. Three retention basins have been constructed, all downslope from Turner Farm Road. According to the NPDES permit, the site will have a disturbed area of 35 acres. At the time of the inspection, a road (now named Turner Farm Road), had been built and paved, running about 0.5 miles to the northwest from Chocolog Road. The road then becomes unpaved but cleared and graded. The road then loops back on itself. The road area is fairly flat, slightly higher to the southwest of the road and sloping down on the northeast side, with the road rising slightly toward the northwest end. Emerson Brook, which is a tributary to the Blackstone River, is located downslope of the site to the north. V. Inspection On 12/13/21, I spoke with Jack Hunter, a planning consultant for the town, who agreed to meet me on site. On 12/13/21, Mr. Hunter spoke with Mr. Frank Marinella informing him that he and EPA would be on site. I arrived at approximately 2pm on 12/15/21. A. Opening Conference I tried calling Mr. Frank Marinella to confirm access to the site, but he did not answer his phone. On site, I approached a man who was working on grading the sidewalk. He informed me that he was Anthony Marinella, brother to Frank Marinella. I presented my credentials and he granted me permission to access the site. I explained I would walk around the site and inspect the erosion controls and compliance with the Construction Stormwater General Permit. B. Facility Tour Mr. Hunter and I began walking up the road. All of the homes except for one home were completed, and the front lawns had all been seeded. A drainage swale had been dug out along the southwest side of the road. At the time of the inspection, there was a steady flow of water through the swales / drainage system. I observed areas where it appeared there was some sediment building up in the drainage areas. Mr. Hunter and I continued walking up the road to where the paved portion ended, and the stumped and grubbed part began. Mr. Hunter explained that he thinks a cistern for the fire department to access was going to be built somewhere in this general area. At this time, Mr. Hunter had to make another appointment, so he departed. 2 ED_019088A_00020111-00002 I walked back downslope to where I noted a downslope path that led to a retention pond. I followed the path, noting a drainage ditch along the south side of the path that leads to the pond. I walked the perimeter of the pond, noting some down silt fences. I observed a spillway on the downslope side of the pond. I noted a path where it appeared water may have discharged from the retention basin. I followed this path about 50 feet downslope. I noted on the map that Lee Pond is north and downslope of this retention pond. I then walked back to Turner Farm Road and continued walking northwest and upslope. I reached the unpaved portion of the road and not much further up I found another path to another retention pond. I followed this path to the pond and documented areas where some silt fences were down. On the map, this retention pond is upslope from Emerson Brook before it flows into Lee Pond. I walked back up the path from the detention pond to Turner Farm Road, turned around and walked back downslope towards the entrance. When I reached the junction where Turner Farm Road loops around on itself, I noted a stockpile in the unpaved portion of the road. The stockpile did not appear to be stabilized. Water was flowing around the stockpile and downslope from the unpaved muddy portion into the drainage swale along Turner Farm Road. I followed the drainage until it reached an inlet into which the water was flowing. I followed the downslope path where I believed the inlet led to and came upon the outlet to another retention pond. I walked the perimeter of the pond and came to the gravel spillway. I noted a few instances of down silt fences and observed a silt fence that had sediment accumulated over one half its height and also was breached. I followed the flow path until I could not see water. I then continued walking downslope, noting stained leaves. I came upon a stream flowing eastward. I consulted the map and confirmed that this stream is a tributary to Emerson Brook. I walked back upslope to the retention pond. I observed an area of the pond that appeared to have some erosion, with a down silt fence downslope of the eroded area. I then walked towards the entrance of the site. I documented the detention basin at the entrance. I noted a catch basin at the south side of the road and an outlet into the detention basin. C. Closing Conference I could not find Mr. Anthony Marinella, so I departed at approximately 3:30 PM. I followed up on 12/16/21 with an email to Mr. Frank Marinella letting him know I had concluded the inspection and informed him that I would follow up with an inspection report and any additional information requests.
