SUBJECT: EXPORTATION OF TECHNICAL DATA OUTSIDE OF THE CONTINENTAL UNITED STATES
"CAVEAT:" There is a particular responsibility and danger involved in sending or giving or communicating technical informa tion abroad:
(a) United States Security Regulations may be violated.
(b) Patent rights of Sherwin-Williams ma.y be lost.
(c) License contract terms may be breached (breach of contract)
DEFINITIONS:
A. Technical Data - Any scientific or technical informa tion including model, design, photograph, photographic negative, document, article, or data containing a plan, specification, description, or technical information which can be used or adapted for use in any process, synthesis or operation for the production, utiliza tion, or reconstruction of articles or materials.
1. Classified Technical Data - Any material or infor mation which has been officially assigned a secur ity classification such as "Top Secret", "Secret", "Confidential" ty an officer or agency of the United States Government.
2. Unclassified Technical Data - All other technical data.
B. Exportation of Technical Data - A release of unclass ified technical data for use outside of the United States (except Canada) and includes actual shipment out of the United States as 'well as the furnishing of data 'within the United States to persons with the knowledge that the persons to whom it is furnished will take such data out of the United States.
C. Country Group 0 - Consists of all locations in the Western Hemisphere
D. Country Group R - Includes all ether locations.

E. Sub Group A of Group R - All Soviet Bloc Countries
REGULATIONS FOR UNITED STATES SECURITY
A. Classified data may not be transmitted at all with out specific government approval.
B. Canadian shipments require no export license from the Department of Commerce unless re-exportation to a third country via Canada will be effected. This includes classified information with only certain exceptions which relate to Military Air craft.
C. Unclassified technical data shipped to countries other than Canada or to Canada for purposes of re-exportation to a third country may be exported from the United States under one of two types licenses.
1. Validated License - A document which author izes the exportation of commodities within specific limitations set forth in the docu ment and is issued only upon formal applica tion in accordance with procedure set forth in the comprehensive export schedule.
2. General License - A priviledge which permits certain exportations within general limitations without requiring that an application be filed or that a licensed document be issued.

Replies to letters and other communications shall be as follows: Two copies of the reply together with a blue envelope addressed according to R&P #172 and mark ed with the appropriate general license, (See Attach ment A) should be sent to: 1. J. W. Tuckerman, Technical Manager, International Operations, Cleveland when it concerns S-W Latin America, Spain> Netherlands, and the Philippines. 2. Appropriate Technical Manager (Attachment B) or C. R. Martins, Coatings Group, Technical Director's Office, Cleveland, if no technical manager applies, when it concerns Dr. Kurt Herberts, Frank Armitage, Coil Coatings licensees, France, Sweden, or foreign points other than those listed in (A) above.
