He reported that Mr. Walker of Firestone has been appointed Chairman of a Nominating Committee. Mr. Walker will be assisted by Dr. Ross Adams and Mr. Don Spencer. The Nominating Committee will also prepare a slate of officers for the coming year. 2- Dr. Torkelson reported on the activities of the Health Committee (report attached). There was considerable discussion of the proposed computerized bibliography and it was determined that the Steering Committee should recommend the project to the full Group. There should be access to the computer file by all interested parties on a cost basis. The Steering Committee will recommend that $18,000 be authorized for the project, the amount estimated by Daniel P. Boyd & Company. Regarding the services of Dr. C. Cooper who was retained to review the available epidemilogic studies on PCV and VCM, it was noted that the $25,000 previously authorized should be sufficient for completion of the project. 3- Mr. Hadley reported that he has now tabulated the VCM discharge data for 2 years (report to be distributed at Group meeting). He indicated that all members are participating, however, there is a lag in the reporting. Messrs. Laundrie and Baise reported on the two meetings held with EDF noting that a written report was included in Mr. Hadley's letter of April 25, 1980. Mr. Baise reported that he would be writing to EPA to indicate that the industry had not agreed to "stricter enforcement" of current emergency discharge restrictions nor reduction in the levels for stripping resins. Regarding the cost of compliance survey, Mr. Hadley reported on the substance of the report to be submitted to EPA on the subject. There was considerable discussion on the merits of collecting additional data on VCM concentrations in the ambient air (fence line) and PVC dust levels (occupational exposure). Dr. DiLiddo suggested that in addition to the technical approach, i.e. presenting data to the agencies, perhaps it is time to begin presenting our cost-risk-benefit case in the public and political areas. Chairman Schaefer suggested that the subject(s) be discussed again at a future meeting. 4- Mr. Hadley reported that the Lawyers Committee did not recommend involvement in the Tenneco/Hooker petitions for a cease and desist order on certain enforcement activity on emergency relief discharges. Regarding a request from the Chlorine Institute to join their suit on the chlorine standard, it was determined that the Steering Committee recommend no involvement because of remoteness of interest. SPI-08975 -3- 5 - Mr. Downey reported that the Communications Committee was operating well within thebudget. Mr. Thomas suggested that a statement explaining the differences in reporting incidences of pneumoconiosis would be helpful in defusing any undue concern about PVC dust. r 6 - Mr. Downey (reporting for Mr. Dan Kent) said that the PVC Fire Safety Committee was busy addressing two issues: the recent NBS report of the presence of phosgene in electrical arcing situations; and, the triannual consideration by the NFPA of the use of PVC conduit. Regarding the former, Mr. Downey noted that a position paper was being developed. Mr. Thomas reported that the European producers had developed such a document and he would send a copy to Mr. Downey. Regarding the latter, Mr. Downey reported that the activity for defending PVC conduit at the NFPA meeting was being headed by Mr. Van Der Voort who had headed the successful effort three years prior. 7- Mr.Walker presented the Financial report (copy attached) noting that the Group was solvent at the moment but that funds needed to be raised for the upcoming year. He noted that the Group expenses were averaging about $20,000 per month. After discussions, it was determined that the Steering Committee should recommend to the Group that $250,000 be raised for the year June 1, 1980 to May 31, 1981, 50% to be assessed now, 50% to be assessed in six months. 8 - The meeting adjourned at 9:45 a.m. with no date set for the next meeting. The Health Committee monitored the NIEHS/NIOSH/OSHA Symposium in Bethesda, Maryland, March 20-21, 1980. The papers and comments were tape recorded and transcribed and the slides were photographed. Two consultants were retained to help monitor the meeting. It was thought that comments on this Symposium might be used in the SPI submission in response to the OSHA request for data. 2. The Symposium produced little that was new; hence, only limited comment will be made about the Symposium in the submission to be made by SPI to OSHA, May 9. 3. References and comments for the OSHA submission are now being collected and prepared by an ad hoc cormiittee working with Joe Hadley. The committee has met twice and will meet again May 1. 4. It is requested that Mr. Hadley be given indication of what individual companies plan to submit to OSHA May 9. 5. We have secured the services of Clark Cooper, M.D. to review the available papers on epidemiological studies on vinyl chloride and polyvinyl chloride. It is estimated that several thousand dollars will be required to complete this project. The assistance of other experts is also being considered on other subjects. 6. We are investigating the possibility of having Dan Boyd Associates prepare a computer indexed Bibliography of pub!ished and public documents related to vinyl chloride and polyvinyl chloride. A similar index has already been prepared for styrene. All companies represented at the ad hoc committee April 18 agreed with the concept. It's difficult to estimate cost, but $30,000 $36,000 seems probable with additional annual costs to keep it up to date. It is not yet certain but it appears likely PVC Safety Group members can use the index at about $30-40/hour ($100 minimum). T. R. Many agreements among competitors, however, are both legal and beneficial to the industry. The best vehicle for enjoy ing the benefits of permitted agreements among competitors while avoiding the pitfalls of illegal agreements is by belonging to a trade association like SPI which takes its obligations in this regard very seriously. All SPI staff members are well versed in antitrust matters and the association relies heavily on their judgment to see that topics which may give an appearance of an agreement that would violate the antitrust laws are not discussed at SPI meetings. The fact that an SPI staff member is present at a meeting, however, should not invite probing to determine how far a discussion can proceed before it becomes apparent that it is improper and is cut off. It is the responsibility of each member in the first instance to avoid raising improper subjects for discussion. This reminder has been prepared to as sure that participants in SPI meetings are aware of this obligation. The Do's and Don'ts presented below highlight only the most basic antitrust principles. Each participant in an SPI meeting should be thoroughly familiar with the SPI Bulletin "The Antitrust Laws and You--A Guide and Introduction to an Understanding of the Federal Antitrust Laws," and should consult counsel in all cases involving specific situations, interpretations, or advice. DON'T 1. IN FACT OR APPEARANCE, discuss or exchange information regarding: (a) Individual company prices, price changes, price differentials, mark-ups, discounts, allow ances, credit terms, etc., or data that bear on price, e.g., costs, production, capacity, inventories, sales, etc. (b) Industry pricing policies, price levels, price changes, differentials, etc. (c) Changes in industry production, capacity or inventories. (d) Bids on contracts for particular products; procedures for responding to bid invitations. (e) Plans of individual companies concerning the design, production, distribution or marketing of particular products, including proposed territories or customers. (f) Matters relating to actual or potential individual suppliers that might have the effect of exclud ing them from any market or of influencing the business conduct of firms toward such suppliers or customers. 2. Discuss or exchange information regarding the above matters during social gatherings inciden tal to SPI-sponsored meetings, even in jest. DO 1. Adhere to prepared agendas for all SPI meetings and object any time meeting minutes do not accurately reflect the matters which transpired. 2.
