We had asked to provide input to this before finalizing. This was the outcome of our deliberations last week. I asked Brian Doll to provide his input to the draft on behalf of the team. I provided that back to API late yesterday. Given the need to move this forward quickly, my method was put something on the table and see where there issues are rather than perfecting alignment among the oversight committee. That strategy has worked and API has rejected the offering we made. See document attached which reflects Brian's input. The biggest issue is around any reference to the January 29th meeting and its significance to the exercise to be triggered by the API letter to go out. I just got off the phone with Howard Feldman after my offering slightly alternative language which arguably should temper their position - but may in fact be unsatisfactory to some. He is to get back to me after 2pm today. He was cautious about where API will come out. I would like to have a teleconference today at 3:30pm Houston time to accomplish two things. First, agree to the final input to the API language given what we hear back from API. While there may be disagreement on what was or was not said in January and February, we should reach agreement on what our position is today. I will try frame up the choices for us so we can move forward. The second thing we should discuss is picking a date / time for a meeting with API. Either we do this today or on the Thursday planned call.
