Notice Register 90, No. 17-Z, P. 691 HEALTH AND WELFARE AGENCY SAFE DRINKING WATER AND TOXIC ENFORCEMENT ACT OF 1986 NOTICE OF INTENT TO LIST CHEMICALS April 27, 1990 Under the Safe Drinking Water and Toxic Enforce ment Act of 1986 [Health and Safety Code Section 25249.8(b)], one of the ways a chemical is known to the State to cause cancer or reproductive toxicity is ifa body considered to be authoritative by the Scientific Advisory Panel has formally identified it as causing cancer or reproductive toxicity. The Health and Welfare Agency has adopted a regulation to guide this part of the imple mentation of the Act (Title 22, California Code of Regu lations, Section 12306). The Panel has identified the following as authorita tive bodies for purposes of the Act: U.S. Environmental Protection Agency (EPA), the International Agency for Research on Cancer (IARC), the National Toxicology Program (NTP), the U.S. Food and Drug Administra tion (FDA), and the National Institute for Occupational Safety and Health (NIOSH). Pursuant to 22 CCR Section 12306, the Agency intends to designate the following chemicals as known to the State to cause cancer or reproductive toxicity. Anyone objecting to the addition of a chemical to the list of chemicals known to the State to cause cancer or reproductive toxicity on the basis that there is no sub stantial evidence that the criteria of sufficiency identi fied in 22 CCR Section 12306 have been satisfied should provide comments, along with supporting documenta tion, to the Health and Welfare Agency no later than June 1, 1990. This is a detailed index of the "underground regulations" determinations issued pursuant to Government Code section 11347.5. Though ordinarily updated quarterly, no index was issued for the first quarter of 1989. A 1986-1988 Determinations Index is also available for the forty-nine determinations issued in 1986 through 1988. Highlights of both Determinations Indexes include: * List of state agencies that were the subject of, or were affected by, requests for determination filed with OAL. * A list of all the rules of state agencies challenged as "underground regulations." * A list of all requesters* and public commenters' names. * Table of all determinations issued and where they may be found in the California Regulatory Notice Register. * General exemptions to Administrative Proce dure Act requirements. * Determination citations to analyses of the defi nition of "regulation." * Rulemaking authority, general and specific. * Tables of all cases, statutes, regulations, and other citations appearing in the determinations. Grumbles May 25, 1990 PROGRESS REPORT VISIA 1. A meeting was held in Lake Charles on 5/23 to review progress on the Benzene Waste Operations NESHAP Initial Report. The Report is due on June 5 from LCCC and Baltimore. 2. The House passed its version of the Clean Air Act. A Conference Committee will be named within a few days. We will receive a fax from CMA with the names of the Committee members as soon as it is available. We should consider sending letters to Committee members from locations where we have operations. 3. JCL, ERT, and Legal provided Environmental training at Aberdeen. 4. A decision has been made not to proceed with a SARA 313 delisting petition for di-n-octyl phthalate. After preliminary investigation, it was determined that the chance of success is low and that there is a risk this activity could trigger more regulation. A meeting will be held with Aristech on June 8 to explain our rationale to them. 5. An executive management seminar was held on the subject of regulatory issues and barriers to new product development. TSCA and OSHA regulations and commercial issues related to product data needs were discussed. 6. TGG participated in a meeting in R&D to review the existing new product development process, define current implementation problems being experienced, and to begin to develop solutions and improvements to the process. 7. MJH attended a seminar on international labeling. Europe, through the EEC, has developed its own chemical labeling scheme, requiring (in many instances) multiple foreign languages to appear on the label. An MSDS requirement for the EEC is expected to be passed soon, and Australia is developing its own unique MSDS and labeling standards. These requirements may have an impact on our future international shipments. 8. The DOT Training and Program Assessment Team is in the process of scheduling a trial audit at the Hammond Plant in June. The Team has also finalized arrangements for the first Vista Transportation meeting on June 13. OOOOl'002 VW 9.
