Dear Mr. Hansen:
This letter is to notify you that the Vista Chemical Company has
completed abatement on the items agreed to in the informal
settlement agreement signed on May 2, 1986 regarding citations
issued to the Vista VCM Plant on April 22, 1986. Specifically, the
following has been done.
)
1. Material Safety Data Sheets have been revised as required by Items 2, 7, and 8 of the citation. Additionally revised MSDSs have been sent to current customers of those products.
2. As required by Item 5 of the citation, label revisions have been prepared to include the name and address of the chemical manufacturer (Vista Chemical Company), and procedures developed to assure no container will leave the plant after the abatement date of June 30 that does not contain the revised label.

Pursuant to the Asset Purchase Agreement dated as of July 20, 1984, among E.I. Du Pont de Nemours and Company, Conoco Inc., and Vista Chemical Company, and the Consent Decree entered in the above action, we hereby provide notice of recently-discovered information which may lead to the filing of an Environmental Claim.
On June 27, 1986, the Vista Aberdeen plant experienced a RVD which resulted in VC emissions. Please contact me if you have any questions regarding this matter.

0-1 is correct in informing their customers that an alumina based product does not have the health hazard potential of a silica based product. However, I share your concern if 0-1 is indicating, by implication or actual verbage, that no further hazard exists.
Nuisance dusts in the respirable range still present an inhalation hazard. The effect, or "disease" potential is different. Nuisance particulates create simple obstructive lung problems versus actual fibrogenic disease as is caused by certain silicas. Both should be avoided.
We would recommend appropriate protective measures be taken, i.e. ventilation and respiratory protection, to prevent excessive exposures to the alumina.
We donTt have specific data on Alumina particles in the nanometer > range. I would suggest we share our concern with 0-1 to assure they
aren't representing the new alumina based product as hazard free. Let me know if you want help with the correspondence.
