Also, enclosed you will find the proposed Order of Dismissal specifically noting that Sherwin-Williams and its carriers over the years are to be dismissed as defendants. This dismissal is without prejudice to reopen? but, there is a statutory requirement that Hartford would have to file a formal Petition for Contribution within one year from the Order Approving Compromise and Release, which in fact issued on November 2, 1988, therefore, Hartford would have until November 2, 1989, to file a formal petition.
