The inspectors met with the Construction Manager, Dylan Cutler, and informed him that a random stormwater inspection was being performed to determine compliance with the Texas Pollutant Discharge Elimination System (TPDES) program and the Construction General Permit (CGP), in accordance with the Clean Water Act (CWA). Before leaving the site on March 4, 2024, the inspectors conducted a closing conference with Dylan Cutler. Dylan Cutler advised us to contact site representative, Don Wims, for site documents and reports, and to discuss Areas of Concerns identified during the CEI (as detailed in Section III of this report). Don Wims was contacted, notified of the CEI, and he provided us the stormwater pollution prevention plan (SWPPP), site map, and inspection reports (from November 15,2022, to March 12, 2024) on March 13, 2024. The inspectors notified Don Wims of the Areas of Concern (AOC) observed in this inspection and explained that if all AOCs were promptly addressed, there would be no enforcement action taken at this time (proof of resolved AOCs documented in Appendix 2). The generation of this report is based on information supplied by Riverside Homebuilder representatives (the permittee), observations made by the inspectors, and records and reports maintained by the permittee, the state of Texas, and the U.S. EPA. FACILITY DESCRIPTION Lakeview Heights is a residential construction site operated by developer Saginaw 106 Ltd. (TCEQ permit number: TXR1547IX) and builder Riverside Homebuilders, Ltd (TCEQ permit number: TXR1557OE). While both entities are responsible for ensuring site compliance with all applicable permits, this inspection is focused on Riverside Homebuilders, Ltd. due to the site being in the building phase of construction at the time of inspection. Lakeview Heights is located south of Lakeview Road and east of Azle Elementary School in Azle, TX (denoted in Aerial Image 1 below). Coordinates to the site are in the vicinity of Latitude 3253'22" North, Longitude 9731'12" West. The site totals 44 acres with approximately 43 acres of land to be disturbed for construction activities. Section II - OBSERVATIONS The following points of discussion are derived from on-site visual observations on March 4, 2024: We observed the Large Construction Site Notice (CSN) (TXR1557OE) posted at the intersection of Lakeview Drive and Gateway Street. The CSN was issued by the Texas Commission on Environmental Quality (TCEQ) with an effective date of September 15, 2023, for coverage under the Construction General Permit (CGP), with a subsequent expiration date of September 15, 2026 (Appendix 1, Photos 1-2). We observed Best Management Practices (BMPs) present on-site. Most of the BMPs present were properly installed and in effective operating condition. However, some AOCs were observed as described below in Section III of this report with photos included in Appendix 1. The issues were discussed with Dom Wims have been addressed as of 3/26/2024 (Appendix 2, Photos 1-19). We observed no evidence of a recent or active discharge of sediment or other construction pollutants from the site to Waters of the United States. The site map provided by Don Wims was missing documented updates of construction progress (required in Section E of the CGP) as described in Section III of this report. No additional concerns were noted upon reviewing the SWPPP and the inspection reports. Section III - AREAS OF CONCERN The following areas of concern are derived from on-site observations from the March 4, 2024 Compliance Evaluation Inspection (CEI) and from documentation provided by Don Wims on March, 13, 2024 (see section IV). Cedar Trail: We observed stockpiles (i.e. sand and dirt stockpiles) not properly contained by BMPs (Appendix 1, Photo 3). 3 Riverside Homebuilders, Ltd / Lakeview Heights Permit #: TXR1557OE Inspection Date: 03/04/2024 We observed sections of worn erosion control blankets along the front of some residential lots, causing exposed sediment along the curbs (Appendix 1, Photo 4). Bristol Lane: We observed a portion of the silt fence and erosion control blanket near the intersection of Bristol Lane and Cedar Trail that appears to have been driven over (Appendix 1, Photo 5). Whitetail Lane: We observed sections of damaged silt fence along the front of some lots that also had other BMPs installed. The silt fence needs to be properly maintained, or removed, along lots that have other effective BMPs present (Appendix 1, Photo 6). We observed sections of worn erosion control blankets along the residential lots (Appendix 1, Photo 7). We observed stockpiles not properly contained by BMPs (Appendix 1, Photo 8). We observed mortar being washed directly onto the lot between 1417 and 1421 Whitetail Lane (Appendix 1, Photos 9-11). Mortar is to be disposed of at the designated washout on-site. Site Map: The site map provided by Don Wims on March 13, 2024, did not specify any change in schedule or BMP updates as of May 16, 2023. On March 22, 2024 Mr. Wims explained that the site map with written updates/changes had not been incorporated into the official AutoCAD site map in the SWPPP binder that was provided on March 13, 2024. Section IV - FOLLOW UP The following information was received by EPA after leaving the site on March 4, 2024: On March 22, 2024, Dom Wims provided an update site map in compliance with Section E of the CGP. On March 25, 2024, March 26, 2024, and March 27, 2024, Don Wims provided photo evidence that all AOCs mentioned in Section III of this report have been addressed.
