Box 8702 Middletown, OH 45043 SUBJECT: OSllA Inspection & Citations For Violations AI; The Coke Plant Dear Bill: McGraw Construction has been cited by the Department of I.abor, Occupational Safety & Health Administration (OSIIA) for violations of Standards Sections 1910 and 1926 of the OSHA Act of 1970. These citations specifically allege violations for which penalties have been imposed. McGraw is contesting all citations; however, there are areas that require action on our part at this time. Those spe cific areas are as follows: A. . A respiratory protection program that provides properly fitted respirators, instructions on how to use them properly, evaluations by a physician to assure the medical fitness for respirator usage, and instructions on respirator storage and disposal, face seal tests, and a written standard procedure available to the employee for use of respirators. B. Employees allowed to consume food in areas contaminated by coke oven emissions. C. Employer did not. initiate or maintain a program of inspections by a competent person on the No. 2 Stille Coke Oven Battery. E. Protective clothing not properly stored to prevent contact with employees during breaks and clothes changes. F. Adequate washing facilities were not provided as required in 29 CFR 1926.51. G. Standard guardrails and toeboards were not installed on scaf fold used on No. 2 Stille Coke Oven Battery. The foregoing 1..i s I. suggests that McGraw has not; provided adequateprotection for it's employees and that we should review our cur rent program to eliminate any area that leaves our employees ex posed to contaminated clothing and equipment or leaves them otherwise unnecessarily exposed to carcinogens.
