Judge Kirner previously issued an Order Approving Compromise and Release for this matter but mistakenly included a Rodders rather than a Thomas finding in the Order. I believe it is important that he amends the Order to include a Thomas finding as requested in the Compromise and Release since injury A0E/C0E is highly in. dispute and this matter settled for a nominal amount. I wrote to Judge Kirner by letter dated April 21, 1993 and again by letter dated June 9, 1993 requesting he issue the amended^Order but to date I have not received any response from him. I spoke with his secretary on July 19, 1993. she advised me that the file was in the file room and had not been reviewed by Judge Kirner since he issued the Order Approving. She retrieved the file from the file room and indicated she would bring it to Judge Kirner7s attention when he returned from his vacation in one week.
