An appeal for rev lew of formal award filed by claimant based on lung surgery performed In April, 1975. Final diagnosis was a carcinoma right lung extensive - Inoperable., squamous cell class V. Dr. York's rwlew of the medical records Indicated "the pathology showed evidence of asbestos bodies." Claimant worked In C plant approxtnately 8 years. On basis of hospital activity, medical report and X-Ray analysis for Or. Sakoloff dated 2/14/74 and 2/4/74 respectively must be discounted. Claimant put In DB claim In 2/75 for pulmonary enphysema, chronic bronchitis and osteo arthritis. Cause listed as "possibly due to asbestos fiber exposure". Extent of disability Is indicated as total for any occupation and not suitable for rehabilitation. o We have two employnent medicals both classifying claimant within class 1. Chest was clear In 1941. In 1946 X-ray showed slight increased fibroses at both bases. We do not have pre-trial physicals. This onployee was hired on 3/13/6B and Is still onployed. Employment records indicate no C plant exposure. Was beateman and hydropul per crane man and operator unttl S/13/74 when he was transferred to vinyl siding. Still onployed. We have two medicals on claimant - 1968 and 1974. In 1968 he had high BP (162/80). 1968 X-ray indications are lungs were clear. In 1974 medical for Siding Plant, claimant indicates he was never exposed to ichonicals, dust, gas or noisy environment. Problems uncovered In 1974 physical not related to exposure according to doctor, but 1974 X-ray of lungs found accentuated hilar and descending trunk markings In the lung fields, possible snail pleurodiaphragmatic adhesions in the lateral third of each hamldiaphragm and pleural thickening. We are without present pre-trial medical data. The 1974 X-ray showing lung changes from 1968 could place us In an untenable position as to whether or not the change was due to an Industrial exposure. We know he worked in the C plant appro ximately 12 years. There Is no pre-trial medical from either respondent or claimant's physician. He has been retired since 6/1/68. Our medical records indicate this man had lung markings in both lungs and an increase in hllus shadows as far back as 8/22/45 when he was hired. Without indication of present medicals, this file is incomplete. However, length of service and C plant snplojment forces us to put this file In the "No Contest" category. We note this file is reserved for 535,000. Claimant entered our enploy 11/11/43 and worked up to her permanent disability 3/22/68 In the C plant. She was hired with normal lungs and classed as "2" based on other physical conditions. In 1945, X-rays showed an accentuation of the GAF 15230 -3 - perebronchlal lung markings of both lungs, most pronounced In the hllum regions and lower lobes especially the left. Doctor Indicated "marked acute bronchitis". We note this case Is reserved at $25,000. This claim has extensive Group Hospital Insurance parents which might be subject to sub rogation. Last day worked Is Indicated as 2/22/69. Claimant worked In the C plant during enploynent. The only preemployaent Indication of ailment was a slightly lower than normal blood pressure; X-rays showed no adverse conditions. Work history as taken by Dr. York does not Indicate C plant exposure, wever. Dr. York's medical etamlnatlon Is a revelation especially respect to his opinion. I.e. "Totally disabled from all causes," and lists arteriosclerotic cardlo vascular disease, surgical residuals from a GAF back Injury, a left nephrectmy, residuals of a gastrec tomy and an enlarged liver. This man Is only 46 years of age. I think the question should be can we get out from under a Total Disability on a statute of limitations having run on his past Injuries and residuals and can we get his current enployer Involved.
