Grumbles April 8, 1987 CALIFORNIA PROPOSITION 65 The attached describes recent regulatory action in California which could, or will, impact some of our products sold or toll processed in that state. The actual impact is not clear because the law's wording is vague and can be interpreted quite broadly. The law requires that a list of known carcinogens and reproductive toxins be published by the Governor. Chemicals on the list will be regulated to prohibit any "significant" discharge of those chemicals into drinking water sources and to require "clear and reasonable" warning to prevent individual exposures. The act defines significant to be any detectable amount. The primary list published on March 1 includes benzene, mineral oils, vinyl chloride, lead and ethylene oxide. We have already received an inquiry regarding the mineral oil listing and it's applicability to ODC. Specific to that issue we feel our LPA solvents are not covered I by the mineral oil listing. Proposition 65, enacted in California by referendum in November, 1986, prohibits the contamination of drinking water with chemicals known to cause cancer or reproductive toxicity, and require warnings prior to exposing any individuals to chemicals known to cause cancer or reproductive toxicity. The law requires the Governor of California to publish a list of those chemicals "known to the State to cause cancer or reproductive toxicity" by March 1, 1987. The chemicals on that list are those to which the drinking water prohibitions and warning requirements apply. On February 27, 1987, Governor Deukmejian published two lists of toxic chemicals. The first list of 29 chemicals are those which have been determined to cause cancer or reproductive toxicity. The second list of approximately 250 chemicals will be reviewed by a Scientific Advisory Panel established by the Governor. The decision to include these chemicals on the list of covered chemicals will be based upon the Scientific Panel's review. Copies of these two lists of chemicals are attached. Following publications of the two lists by the Governor, a number of environmental groups, among others, filed suit against the Governor. The suit generally alleges that the Governor did not include enough chemicals on the first list. CSMA also has available interpretive guidelines and procedures promulgated by the California Department of Health and Welfare. The interpretive guidelines provide definitions to many of the terms used in the Act. The procedures review the steps the Department of Health will take to make safe use determinations. We will keep you advised of other steps taken to implement Proposition 65. : me vvv O00023382 CHEMICALS KNOWN TO CAUSE CANCER OR REPRODUCTIVE TOXICITY The Safe Drinking Water and Toxic Enforcement Act of 1986 requires the Governor to publish by March 1, 19S7 a list of those chemicals known to the State to cause cancer or reproductive toxicity. Health and Safety Code Section 25249.8(a). The attached list includes all those chemicals which are known to cause cancer in humans as determined by World Health Organization's International Agency for Research on Cancer (IARC) or the United States Public Health Service's National Toxicology Program (NTP). in audition, the list includes the three chemicals currently regulated by the United States Department of Labor's Occupational Safety and Health. A primary list of chemicals known to the State to cause cancer or reproductive toxicity has been published as required by the Act. However, it is also necessary to begin the process of considering additions oo r.his primary list. What follows is a list of candidate chemicals which is being referred to as the Safe Drinking Water and Toxic Enforcement Act Scientific Advisory Panel for its consideration and opinion. This list of candidate chemicals includes chemicals for which there is limited evidence of carcinogenicity in humans or sufficient evidence of carcinogenicity in experimental animals as identified by the World Health Organization's International Agency for Research on Cancer (IARC) or by the United States Public Health Service's National Toxicology Program (NTP). Under the terms of the Act, the Scientific Advisory Panel Jis responsible for reviewing the available data concerning these chemicals and any other chemicals which are suspected carcinogens or reproductive toxicants and forming an opinion on whether such chemicals have been clearly shown through scientifically valid testing according to generally accepted principles to cause cancer or reproductive toxicity. A review of Blane hazardous waste management practices was completed and recommendations made. 2. A presentation was made to PVC TSR's and Business Area regarding environmental impacts on the PVC business. 3. BFG settled an EPA/DOJ lawsuit on VCM emissions from its Calvert City Plant for $123M plus projects to prevent recurrence. 4. T. G. Grumbles attended The Management Process training, March 30 - April 3. 5. EPA was notified under TSCA 8(e) that groundwater contamination may have migrated beyond the fence line at LCVCM. 6. The EPA proposed new reportable quantities for several substances under Superfund. The materials manufactured, processed or used by Vista affected by this ruling include vinyl chloride, methyl chloride and benzene. A memo was sent to the Plant Environmental Coordinators. T. G.
