(b> Contents of the docket. For each pre-Special Review or Special Review, the docket shall contain: <1> The Notice of Special Review, any Notice of Preliminary Determina tion. and any Notice of Final Determi nation. (2) Any notice issued under i 154.21 or 1 154.23. <3> Any documents (other than in formation claimed to be confidential business information) referred to by the Agency in-those notices as relied upon by the Agency in reaching its de termination. (4) Copies of all written comments or materials (other than information claimed to be confidential business in formation) responding to any notice furnished under 1154.21 or 1 154.23 or submitted at any time during the Spe cial Review process by any person out side of government. (5) Any written response to the Notice of Preliminary Determination from the Secretary of Agriculture or the Scientific Advisory Panel. (g) A transcript of all public meet ings held by the Scientific Advisory Panel or conducted by the Agency for the purpose of gathering information. (7) A memorandum describing each meeting between Agency personnel and any person or party outside of government which concerns a pending pre-Special Review or Special Review decision. Each such memorandum shall be based on notes taken at (he meeting and shall specify the date and time of the meeting, the participants and their affiliations, who requested the meeting, the subject matter of the meeting, and the person who prepared the memorandum. Except for informa tion claimed to be confidential busi ness information, each memorandum shall describe fully and accurately all significant positions taken, arguments made, and facts presented by each par ticipant in the meeting, and shall iden tify all documents, proposals, or other materials distributed or exchanged at the meeting. Any discussion of claimed confidential business information shall be identified in meeting notes and referenced in the memorandum. (8) All comments, correspondence, or other materials concerning a pending pre-Special Review or Special Review decision provided to the Agency by a person or party outside of government (other than information claimed to be confidential business information). (9) All documents, proposals, or other materials concerning a pending pre-Specia) Review or Special Review decision, provided by the Agency to any person or party outside of govern ment. (other than information claimed to be confidential business informa tion). (c) Assertion of confidential business information claims. (1) Information, comments, data, or other written ma terial submitted to the Agency con cerning a Special Review may be claimed by the submitter to be confi dential business information. The burden of identifying claimed confi dential business information rests with the submitter, or, in meetings, with the participants who wish to assert a claim of confidentiality. (2) To assert a claim of confidential ity for all or any part of a written sub mission concerning a Special Review, the submitter must furnish three copies of the material. Two copies must be complete, with claimed confi dential business Information clearly marked in the text. Items in the docu ment that are claimed confidential should be numbered consecutively throughout the text. The third copy must have the claimed confidential business information excised from the text without closing up or paraphras ing the remaining text. The deletions should be consecutively numbered to correspond to the numbering of the complete copies. Each copy must be marked on the cover as to whether it contains claimed confidential business information. (3) Any written material concerning a Special Review received by the Agency that is not marked as confi dential will be deemed to be nonconfidential. and may be made available through the public docket or other wise disclosed without prior notice to the submitter. (d) Placement of materials tn the dockeL Any memorandum identified under paragraph (bM7) of this section shall be placed in the docket wilhin 10 working days of the subject meeting. Materials identified under paragraph (bM8> of this section shall be placed in the docket within 10 working days of receipt by the Office of Pesticide Pro grams. or within IS working days of receipt by the Office of Pesticide Pro grams if the submitter has asserted a confidential business information claim concerning the submittal. Mate rials identified under paragraph (bX9) of this section shall be placed in the docket within 15 working days of transmittal to such person or party outside of government. (e) Index. The Agency shall prepare and maintain a current index of all materials Included in the docket. The index will include a Ifst identifying, for each meeting between Agency person nel and a person or party outside of government for which a memorandum has been prepared, the date, the sub ject, participants, and person who re quested the meeting. The index will also list any document included in the docket by its title, its source, its recipi ent. and the date it was received or provided by the Agency. (f) Access to the dockeL (IXi) For each chemical in Special Review, the docket shall be available for public in spection and copying and its index kept current and made available to the public on request. The docket and index for any pesticide for which the Agency has issued a pre-Special Review notification under f 154.21 will only be made available for public in spection and copying following issu ance of a proposed decision not to start a Special Review under 1154.23, a Notice of Special Review under f 154.25(c), or as otherwise specified in f 154.34. (U) The docket and index will be available at the Program Management and Support Division, in Rm. 235. CM#2. 1921 Jefferson Davis Highway, Arlington. VA. from 6 a.m. to 4 p.m. Monday through Friday, excluding legal holidays. (2) Information contained in the docket shall not be disclosed to the public to the extent that FIFRA or any other statute or regulation (in cluding. but not limited to, 5 U.S.C. 552(b)(3) or (4 prohibits its disclo sure. (3) The /-gency will distribute s com pendium of indices for new materials in the public docket by mail, on a monthly basis, to those members of the public who have specifically re quested such material. The Ageney will announce the availability of docket indices both annually in the PxocftAi. Register and in each Federal Register Notice concerning pre-Special Review or Special Review for spe cific pesticides. Release Status of the Documents Each document has been assigned a number with the prefix "D" for "docket." Each document number also has the suffix, "A", "B", or "C". This suffix gives the release status of the document. Documents with suffix "A" are automatically available to anyone. Documents with suffix "C" are claimed as confidential by the submitter. To release a "C" document, we must first give the submitter an opportunity to provide written comments substantiating the confidentiality claim. The EPA Office of Generad Counsel must then determine if the document is entitled to confidential treatment. Submit an Affirmation of Non-multinational Status for "B" Documents Documents with suffix "B" are releasable to those who submit an Affirmation of Non-multinational Status. PROTECTION OF TRADE SECRETS AND OTHER INFOR* MATION. *4(g) Disclosure 10 Foreign and Multinational Pesticide Producers.-- '*(1) The Administrator shall not knowingly disclose information submitted by an applicant or registrant under this Act to any employee or agent of any business or other entity engaged in the production, sale, or distribution of pesticides in countries other than the United States or in addition to the United States or to any other person who intends to deliver such data to such foreign or multinational business or entity - unless (he applicant or registrant has consented to such disclosure. The Administrator shall require an affirmation from any person who intends to inspect data that such person does not seek access to the data for pur* poses of delivering h or offering it for sale to any such business or entity or its agents or employees and wilt not purposefully deliver or negligent* ly cause the data to be delivered to such business or entity or its agents or employees. Notwithstanding any other provision of this subsection, the Administrator may disclose information to any person in connection with a public proceeding under taw or regulation, subject to restrictions on the availability of information contained elsewhere in this Act. which information is relevant to the determination by the Administrator with respect to whether a pesticide, or any ingredient of a pesticide, causes unreasonable adverse effects on health or the environment. '*(2) The Administrator shall maintain records of the names of per* sons to whom data are disclosed under this subsection and the persons or organizations they represent and shall inform the applicant or registrant of the names and affiliation of such persons. '*(3) Section 1001 of title 18 of the United States Code shall apply to any affirmation made under paragraph (I) of this subsection. i VVV 000012083 EXPLANATION OP THE AFFIRMATION OF NON-MULTINATIONAL STATUS Pesticide information that is responsive to your recent FOI request includes information that was submitted to EPA by pesticide applicants or' registrants under the Federal Insecticide/ Pungicide, and Rodenticide Act (FIFRA). in the 1978 amendments to FIFRA, Congress expressly limited who may receive this infor mation and how it may be used by recipients. These limits/ expressed in FXFRA section 10(g)/ were imposed by Congress to protect registrants of pesticides in the U.S. against unauthorized use of their health and safety data by competitors to obtain pesticide registrations in foreign countries. (Those who obtain pesti cide registrations in foreign countries are called "Foreign or Multinational Pesticide Producers" in section 10(g)/ abbreviated "Multinational" herein.) FIFRA section 10(g) therefore requires EPA to avoid knowingly disclosing this information to a Multinational/ or to agents or employees of a Multinational. Numbered paragraphs (1) and (2) of the "Affirmation of Non-Multinational status" are designed to allow EPA to implement this requirement. Section 10(g) also requires each person who seeks to obtain this information from EPA to affirm that he or she does not intend to, and will not purposefully or negligently deliver (or cause delivery of) the information to a Multinational. Numbered paragraph (3) of the Affirmation is designed to allow EPA to implement this requirement. The remainder of this explanation is provided to further assist you in understanding section 10(g) and the implications of signing the Affirma tion. Section 10(g) makes it unlawful for a person requesting registrant-submitted pesticide information to furnish a false or misleading Affirmation of Non-Multi national Status to EPA; such violations are punishable under 18 DSC 1001. Thus, for example, it is EPA's position that it would be unlawful for a person to execute the Affirmation while having the intent to publish (or otherwise to deliver in any way to a Multinational in its entirety) a previously unpublished toxicity study submitted by a registrant. This is because the information delivered likely could be used to satisfy a data requirement imposed by a foreign country as a condition of producing, distributing, selling, shipping, or using the product in that country. However, section 10(g) would not restrict an intent to publish or deliver brief excerpts from such information or summaries or critiques of it, identified as such, since these likely would not be useful in satisfying data requirements imposed by other countries. Of course, the prohibi tion does not apply to publication or delivery of information that is already freely available to the public (such as data that has been published) or to publication of data with the consent of the registrant that submitted it to EPA. It is less clear whether the statute imposes any other duties or prohibi tions on persons once they have received the information from EPA, and EPA has taken no position on this issue. Some firms who have submitted data to EPA, however, argue vigorously that section 10(g) governs the use or disclosure of data by persons who have obtained it from EPA. Accordingly, you should be aware that if your disclosure of data obtained by you from EPA results in its becoming available to a Multinational (in a form that enables it to be used to satisfy foreign data requirements), it is possible that the firm that submitted it to EPA may seek relief against you in court, and may argue in court that you were required by section 10(g) to guard against disclosing data to a Multinational or allowing such disclosure. You may therefore wish to take steps to avoid inadver tent disclosure of the data by keeping it in a secure place. Before publishing it or deliberately disclosing it to others, you may wish to seek legal advice.
