PLAINTIFFS EXHIBIT STATE OF TEXAS HARRIS COUNTY AFFIDAVIT I, Tony A. Roppolo, being duly sworn, state and affirm the following: ' 1. I am presently employed by Brown & Root Industrial Services, Inc. as a Vice President of Business Development. I began working for Brown & Root in and have held the following positions: 2. Fromto I worked for Brown & Root at the Union Carbide Brownsville, Texas facility, where I held the position of Building Trades Superintendent where one of my responsibilities was to supervise the replacement and removal of asbestos insulation at the site by Brown & Root pursuant to its contract with Union Carbide for general maintenance work. DE 006948 3. In accordance with the normal records retention policy of Brown & Root, the invoices and expense records have been purged for the period from 1962 thru 1972 and no such records are currently kept by Brown & Root. Based, however, on my knowledge, from my business capacity, as to the scope of the asbestos removal and replacement work performed by Brown & Root at the Union' Carbide Brownsville, Texas Facility, and paid by union Carbide to Brown & Root the $5,945,138 estimate for the period of 1962 thru 1982 submitted by Mr. William S. Callaway in the Affidavit dated October 30, 1991 is a fair estimate. Based on my personal knowledge and belief, the total dollars for general maintenance work performed by Brown & Root for Union Carbide at its Brownsville Texas Facility for the period of 1962 thru 1982 would have been approximately $100 million. "4. In the early period from 1962 thru 1972 the majority of the insulation work was replacing and removal of insulation.
