Present Don Burnett, BP Myron Harrison, ExxonMobil Jennifer Galvin, Conoco Phillips Brian Doll, ExxonMobil Mark Fitzsimmons, Council Absent Zach Wong, Chevron Texaco Purpose - to review the response by API to the comments the Oversight team made on the API draft letter to UoC / Richard Irons. Phil Snyder reviewed APls view that neither of the two changes offered were acceptable. One referenced the January teleconference which was viewed as irrelevant to the purpose of the letter and the other proposed change reflected minimization of the role that API plays (contractor holder vs administrator). We discussed the fact that contracts need to be in place before we can move forward (Jennifer). Conoco Phillips is not anti-SimpathoGen but pro finishing the study. Her letter, now withdrawn was open and did not mention SimpathoGen. We discussed the fact that API believes it will take 3 weeks to progress the contracts through API once received. There was some acknowledgement that API needs to follow their process. There has not been any movement regarding securing funding commitments from the individual companies (Brian). Discussed the email received this morning from Richard Irons indicating there was no funds to pay employees, etc. All confused by this since we can account for 1.5 min which is either in hand or will be in hand shortly. The intention of ExxonMobil in the comments they offered was to "solidify" the position of Richard Irons with his employer (Myron). API has indicated that the Oversight committee should not concurrently issue any further communications in parallel with the API letter otherwise we will cycle back to where we were last week (Phil). API was ok with individual companies making communication. We agreed that individual companies should not make such a communication as it would tend to fragment the team in the eyes of UoC or Richard Irons. The letter from API was viewed as very "matter of fact". Some individuals on the team were concerned for the reaction Irons may have and sought to make the letter more friendly. Various proposed changes were made to the letter, tending to give some recognition that the Oversight team is still a player. SH ELL-MCCLU RG-067325 There was a conversation that Richard Irons might get the impression that he now needs to work with API. It was pointed out that this is in fact what he must do. There was some discussion on the word "acceptable" as in acceptable quality controls Mark indicated a concern that this implies a level of control that the Oversight committee should not have. It was pointed out that having such controls is a condition by Shell and others. We agreed to create linkage to the attachment of Jennifers February letter, now withdrawn which reflects the intention to secure an acceptable quality control plan. It was observed that Dr Irons was not happy about any implication that he lacked appropriate quality controls. A sensitive subject. We discussed the possibility of a teleconference with Irons and the UoC to explain what is going on, but to not take a position contrary to the API letter. Agreements To provide comment back to API to make their letter less matter of fact. See marked up letter. The one item that the team felt very strongly about was the use of the word "acceptable".
