P. 194.2, Defendant Amoco Corporation, ("Amoco") responds to Plaintiffs' Request for Disclosure 194.2(a)-(c), (e)-(g), (i) and (k). (a) The correct names of the parties to the lawsuit. Answer: Amoco Corporation, as named in Plaintiffs' Petition, is correct as stated. Amoco has no personal knowledge regarding the correct names of other parties to this suit. (b) The name, address and telephone number of any potential parties Answer: Unknown at this time. (c) The legal theories and, in general, the factual bases of the responding party's claims or defenses. HOL':6I 7243.1 -1 - 4E- - Answer: Amoco was recently joined in this lawsuit. Discovery as to Amoco is far from complete at this time. Amoco is in the process ofdiscovering the facts in this case as well as its legal theories. However, at this time, Amoco's defense is based upon the assertions and legal theories made in its Original Answer filed in this case. (e) The name, address and telephone number of persons having knowledge of relevant facts, and a brief statement of each identified person's connection with the case. Answer: Amoco was recently joined in this lawsuit. Discovery as to Amoco is far from complete at this time. Amoco is still in the process of discovering the facts in this case as well as its legal theories. Amoco presumes that Plaintiffs have knowledge of facts relevant to the claims made in their original petition. Defendant will supplement in accordance with the Texas Rules of Civil Procedure. (f) Testifying expert witness information. Answer: Amoco was recently joined in this lawsuit. Discovery as to Amoco is far from complete at this time. Amoco is in the process ofdiscovering the facts in this case as well as its legal theories. At this time Amoco discloses information pertaining to the following witnesses: J. Leroy Balzer, Ph.D. 408 Horse Trail Court Walnut Creek, CA 94595 Dr. Balzer will be called as an expert witness to testify on this matter. Dr. Balzer has a Bachelor of Science degree in public health, microbiology and a Master of Science degree in preventive medicine/public health from the University of California in Los Angeles, 1962 and 1963 respectively. Dr. Balzer has earned a Doctor of Philosophy degree in environmental health science -- industrial hygiene from the University of California at Berkeley in 1971. From 1963 to 1965 Dr. Balzer worked as an environmental health scientist for the University of California at Berkeley and from 1966 to 1971 was employed by the University of California of Public Health as a research associate and research fellow. In 1966 Dr. Balzer became involved in a coordinator research program ofoccupational medicine, industrial hygiene and education of insulation contractors and the Western States Conference ofAsbestos Workers in the San Francisco HOU:617243.1 -2- HOU:617243.1 Bay area and later the 13 western United States. This intense study of the construction industry, including petrochemical and power plants, was sponsored through grants from the United States Public Health Service and involved observing the work environment insulators. He performed additional research which included air studies for fibrous mineral materials and also product development in the manufacturing of insulation material. Along with his Ph.D. and University research, Dr. Balzer was an industrial hygiene consultant for the firm of Tabershaw-Cooper and Associates. The focus of that work was to study issues associated with the effects of fibrous materials such as asbestos and fiberglass and resulted in more than a dozen peer-review publications. From the fall of 1971 until 1987, Dr. Balzer was employed by Utah International, Inc., a natural resource company, as the Director of Environmental Health and Safety and as Director of Market Research. Dr. Balzer has lectured in occupational/environmental health and safety in the United States and internationally. He is a member of the American Conference of Governmental Industrial Hygienists, American Industrial Hygiene Association and other professional organizations. Dr. Balzer's opinions are gained through years of experience in practice and through participation in numerous related activities. He has reviewed millions of documents which form the basis of his opinions. The identity and location of all these documents is impossible to know and list. Dr. Balzer has reviewed Amoco Company records with respect to the provision of its industrial hygiene services to its subsidiaries. Dr. Balzer has extensive knowledge as to what was known in the petrochemical industry with respect to industrial hygiene standards during the plaintiffs alleged exposure dates. Dr. Balzer will testify that Amoco's industrial hygiene practices were within the acceptable standard of care for a premises owner at the relevant time period. Dr. Balzer in his review of Amoco's documents and interviews with former employees ofAmoco, is in a position to testify as to Amoco's use of the January 1946 article "A Health Survey of Pipe Covering Operations in Constructing Naval Vessels" by Walter E. Fleisher, Frederick J. Viles, Jr., and Robert L. Gade and Philip Drinker. Dr. Balzer will also be prepared to testify as to the role, threshold limit values played in Amoco's industrial hygiene practices. -3 - - Dr. Balzer.will opine on Amoco's overall historical industrial hygiene practices and compare it to industry standard. Jerome Siedlecki Former Head of Amoco Industrial Hygiene Department Mr. Siedlecki was head of Amoco's Industrial Hygiene department From 1972 until he retired in 1986. Mr. Siedlecki would be responsible for the implementation and coordination of Industrial Hygiene services. Amoco's formal Industrial Hygiene Department began in 1953. Mr. Siedlecki will testify concerning Amoco's historical Industrial Hygiene practices. Mr. Siedlecki will testify as to the activities and policies ofthe Industrial Hygiene Department. Mr. Siedlecki has been previously deposed in a de bene esse deposition. R. Allen, et al. v. Am Petrofina, et al., December 17, 1996. Mr. Larry Durland Plant Manager Amoco Oil Company 2410 5th Avenue South Texas City, Texas 77590 Mr. Durland is familiar with Amoco Oil Company's safety program during his employment. He has extensive knowledge of the facilities and safety practices. This response will be supplemented in accordance with Rule 195.2 of the Texas Rules of Civil Procedure. (g) Any discoverable indemnity and insuring agreements. Answer: Generally, Amoco is self-insured. By further response, a recap of currently identified liability policies for the years of 1959 to 1987 is attached, which represents a portion of potential policies on the risk (i) Any discoverable witness statements.
