Box 4963 y Syracuse, New York 13221 Attention: John Mulcahy Sr. Claim Representative RE: Your File No. Our File No. REDACTED H 52CC 4187219 78-3783DC RG Dear Mr. Mulcahy: Thank you for sending me copies of the medical reports of Henry R. Bartos, M.D. and George R. Burnett, M.D. After reviewing these reports, there are several questions that I would like to ask you. Did Dr. Bartos ever examine > ? Based on his two reports, it appears that he only reviewed your claim file. If an examination was not performed by the doctor, I would like to know the reasons why. It would appear to me that Dr. Bartos1 report would carry more weight if he actually examined Although Dr. Burnett's report gave us some interesting information concerning the claimant's past medical history, I find it hard to believe that the New York Workmen's Compensation Board could base their decision of allowing claim on this report. Nor can I believe that the allowance was based on the previous C-4, "Attending Physician's Sup plementary Reports" that were completed by J. Robert Smith, M.D. on February 9, 1979 and May 20, 1979. None of these reports indicate a positive relationship between leukemia condition and her em ployment. Is there an additional report that you have not sent to me from a doctor who indicates a direct relationship between : employment and her leukemia condition? This is the report that we are most interested in. We would again like to reiterate the fact that we feel J claim should be appealed until we receive a favorable decision. Your co operation in answering the questions I have raised in this letter may en able us to assist you in your defense of this claim. Thank you for your cooperation in this matter. Very truly yours, THE SHERWIN-WILLIAMS COMPANY TML:j e N40537 T. M. Locker ........................................ Administrator of Workers' Compensation REDACTED
