The inspection was conducted by the authority of the Clean Water Act (CWA) to determine compliance with Environmental Protection Agency (EPA) regulations. There was no other federal, state, or local agency representative present at the time of the inspection. FACILITY DESCRIPTION EPA conducted an inspection at the Novy Oil and Gas Inc., Pearsonia Lease, where an oil/water separator malfunctioned, forcing saltwater into the oil storage tanks, eventually forcing oil and saltwater from the tanks into the secondary containment of the facility. The secondary containment was overfilled and spilled into a nearby unnamed tributary of North Bird Creek. Spill impacts continued downstream and impacted North Bird Creek. Section II - OBSERVATIONS I observed the first pool of water along the impacted unnamed tributary of North Bird Creek. During the initial inspection, this pool was covered in oil. No oil was present at the time of the inspection. See photo No. 1. For additional GPS location information and photo metadata, please see Appendix 1 (photo log) attached to this report. I observed absorbent pads and significant oil floating on the unnamed tributary, immediately upstream from the confluence with North Bird Creek. See photo No. 2. Looking downstream, I observed an absorbent boom and a significant amount of oil floating on North Bird Creek at the point of entry into North Bird Creek. Clean-up crews were actively removing oil from the creek during the inspection. See photo No. 3. I observed oil on North Bird Creek, looking upstream from the point of entry into North Bird Creek. See photo No. 4. At the lowermost containment site, there was no oil present at the time of the inspection. See photo No. 5. 2 Section III - AREAS OF CONCERN Novy Oil and Gas Inc. / Pearsonia Lease (CWA) Inspection Date 07/24/2025 The primary area of concern was the oil impacted water along the unnamed tributary of North Bird Creek and North Bird Creek. Section IV - FOLLOW UP EPA inspector will conduct follow-up calls, field meetings and inspections to ensure the impacted area is returned to "pre-spill" condition.
