A copy of the inspection report is enclosed with this letter. Based on observations made during the inspection, it appears that the site is subject to EPA's NPDES Multi - Sector General Permit for Stormwater Discharges Associated with Industrial Activity (" MSGP ") See https://www.epa.gov/npdes/stormwater-discharges-industrial-activities- epas-2021-msgp. Discharges of stormwater from sites that fall under Sector J of the MSGP (" Mineral Mining and Dressing ") are not authorized, unless such a facility obtains coverage under the MGSP or an individual NPDES permit. Within 14 days of this letter, provide: 1) a plan for completely eliminating stormwater discharges from industrial activities at the site; or 2) a plan and schedule for obtaining MSGP coverage for stormwater discharges from the site; or 3) if you disagree that stormwater discharges from the site require MSGP coverage, a statement explaining why you believe such coverage is not required.
