Good afternoon, thanks for everyone's timely response to the Draft Review Plan. Attached, FYI, is the version that was sent to the Chief's office on 4/20.
MGM Director Nick Douglas has advised this review team to proceed with working on Phase 2 of the FS response, which is to conduct reviews of the applicable agency actions and prepare a draft report per section 2 (d). Descriptions of team responsibilities are as follows:
Team members from the MGM staff are expected to lead the effort, be responsible for providing timely drafts of the review plan and reports to the Executive Point of Contact, coordinate review and comments from other staff groups. The MGM staff is charged with ensuring timeframes established in the EO are met (see Sections VI and VII). The MGM staff will compile feedback from other Director Areas for the draft and final reports. MGM staff will also be responsible for identifying agency actions for review; reviewing and writing results of their review for the draft and final reports, and making recommendations to eliminate or alleviate burdens to domestic energy production or delivery within the minerals program.
Team members from Director Areas other than MGM are expected to provide timely review and feedback to the MGM staff as requested. These team members are also expected to support the MGM staff by making contacts outside the agency for coordination purposes with partner agencies in their respective programs as needed. As applicable to their program area, these team members will be responsible for identifying agency actions for review; reviewing and writing results of their review for the draft and final reports, and making recommendations to eliminate or alleviate burdens to domestic energy production or delivery.
To facilitate your review, please use the attached WO Specialist template. Please consider the following in your review:1 2
1. The Draft Review Plan, Sections IV to identify agency actions that may be applicable to your program area to review; and Section V on what not to review.
2. Regarding the mandate in the EO that agency actions not subject to review include those mandated by law, Director Douglas advises that the team need not review the specific laws, or actions established directly within the law, however the team does need to review FS practices related to those laws. For example, the Energy Policy Act of 2005 established 5 categorical exclusions for oil and gas activity. The MGM staff will not review the law, however we will be reviewing agency guidance that was written in how to comply with it. Please use this approach to determine if you have similar circumstances in your program area.

3. Due date for reviews is June 1, 2017. Earlier submittals are encouraged and welcome!
I will send via a separate invitation for a conference call next week to update the group on status of the effort, and field any questions.
FYI, there will be a data call to the ROs requesting their review of Regional-level and unit-level agency actions that respond to this EO. That is expected to be conveyed next week.

For Executive Order of March 28, 2017 -- Promoting Energy Independence and Economic Growth
Section 2 of the Executive Order (EO) mandates an "Immediate Review of Ail Agency Actions that Potentially Burden the Safe, Efficient Development of Domestic Energy Resources. The heads of agencies shall review all existing regulations, orders, guidance documents, policies, and any other similar agency actions (collectively, agency actions) that potentially burden the development or use of domestically produced energy resources, with particular attention to oil, natural gas, coal, and nuclear energy resources. Such review shall not include agency actions that are mandated by law, necessary for the public interest, and consistent with the policy set forth in section 1 of this order."
Subsection 2(c) of the EO further instructs federal agencies to prepare a review plan of the applicable agency actions. The Forest Service provides the following Review Plan in response to Section 2(c) of the EO.
