There was no company representative present during the inspection. This was an EPA follow-up inspection, related to the initial spill inspection conducted 3/12/2026. The initial inspection was in response to a National Response Center Spill Report (NRC# 1456239) which was received by EPA Region 6. The inspection was conducted by the authority of the Clean Water Act to determine compliance with Environmental Protection Agency (EPA) regulations. There were no other tribal, state or federal partners present at the time of the inspection. FACILITY DESCRIPTION EPA conducted a follow-up inspection at the, McCann Resources Inc, Bowring Lease, (GPS 36.909141, -96.121457) where a 2-inch diameter poly flowline carrying produced water (brine and oil) failed, releasing produced water into the main channel of an unnamed tributary of Hulah Lake. The flowline carried fluids from production wells to the separation/storage facility (Bowring Lease tank battery). The Bowring Lease was located northeast of Bowring, Oklahoma, in Osage County. Section II - OBSERVATIONS I observed the release point and the point of entry (POE) into the unnamed tributary of Hulah Lake. The straw, straw bales and most of the oil-stained soil observed during the initial spill inspection were covered by recent bulldozer activity which collapsed the banks and filled in the main channel of the tributary. Oil-stained soil was still present, indicating the contamination had been covered up rather than removed from the impacted tributary. See photo No. 1 of the attached photo log. For additional location and photo metadata, see Appendix 1, photo log, which is attached to this report. Downstream from the POE, I observed collapsed banks, steel pipe, trees and clean soil, which were used to cover up the oil in the tributary. At the same location, I observed oil-stained soil in the channel where the fill material did not completely cover the main channel, evidence the oil in the tributary was covered up rather than removed, see photo No. 2. Continuing downstream, I observed additional fill material of trees and soil as well as oil-stained vegetation and soil where the fill material was not completely covering the bed of the tributary. See photo No 3. Beyond the point where the tributary was filled in, I observed oil-stained soil, leaf, and stick debris in the main channel of the tributary which had not been removed. See photos No. 4. 2 McCann Resources, Inc / Bowring Lease Inspection Date 03/23/2026 Continuing downstream, I observed oil floating in the impacted tributary. See photo No. 5. I observed additional oil-stained soil, leaf and stick debris in the channel of the impacted tributary, which had not been removed in the clean-up process. See photo No. 6. At the time of the inspection, the floating containment boom and oil absorbent containment booms were still in place at the end of observed spill impacts, but the containment was inadequate to prevent downstream migration of spill impacts if the area were to experience a moderate rainfall event. Section III - AREAS OF CONCERN Mark McCann (operator) notified the EPA inspector Friday, March 20, 2026, the clean-up was complete, which prompted the follow-up inspection. At the time of the inspection, cleanup was not complete, partial coverup and unauthorized stream channel filling/modification had been completed. The primary areas of concern included the oil which was covered up instead of removed from the tributary, the collapsed banks of the tributary, and the pipe, trees and soil which were used to fill sections of the impacted tributary. At the time of the inspection, cleanup was not complete, and containment measures were inadequate to prevent downstream migration of spill impacts (oil) if the area were to receive moderate rainfall. The spill was not adequately contained. Section IV - FOLLOW UP EPA Inspector Matthew Allen, conducted a follow-up call with Oklahoma Department of Environmental Quality (ODEQ) inspector Mark Bersche and US Army Corps of Engineers (USACE) ranger, Raef Perriman. USACE was elevating the event through their chain of command since the incident occurred on USACE owned land. EPA and ODEQ are awaiting follow-up information from USACE before providing further guidance to the operator concerning the fill material which is covering the oil in the tributary. EPA inspector will provide additional information to the operator as it becomes available from USACE. EPA inspector will continue to cooperate with ODEQ and USACE personnel to follow all regulations related to the U.S. government owned land. EPA inspector will conduct follow-up inspections to observe progress until the area is cleaned to "prespill" conditions.
