Many thanks for your questions. I was asked to provide you with answers, as far as this is possible for DG GROW.
Please be aware that the responsibility for Regulation 649/2012 lies within the Commission with DG ENV, unit B.2
), to which I would like to refer you for a definite answer.
To my knowledge, PFOA is currently not yet included in Regulation 649/2012 (PIC Regulation). Therefore, the
requirements of Regulation 649/2012 as regards export of a chemical substance (such as export notification, explicit
consent of the importing country etc.) do not apply for PFOA.
Regulation 649/2012 transposes decisions taken under the Rotterdam Convention into EU law. The Chemical
Review Committee of the Rotterdam Convention recommended the inclusion of PFOA into Annex III of the
Rotterdam Convention at its 14th meeting in September 2018 and at its 15th meeting in October 2019. (further

US/Default.aspx). Decisions on listing of chemical substances in Annex III are taken by the Conference of Parties
(COP) of the Rotterdam Convention. To my knowledge, the next meeting of the COP takes place in May 2021. If the
COP decides to list PFOA in Annex III of the Convention, then the decision needs to be transposed into EU law via
amending Annex I of Regulation 649/2012.
