The case was tried last week and r e s u m e d in a jury disagreement. We understand the jury voted seven for the plaintiff and five for the defendant. We consider a jury disagreement in a South Carolina case of this importance to be a real victory. In addition, the first impression of our counsel is that the plaintiff has made so many damaging admissions in his testimony on oath that the case may not be re-tried. I personally want to express to you and your associates my appreciation of the prompt cooperation you have given me in handling these problemsT In addition, I want to pass on to you the comments our South Carolina counsel who handled the case have sent me with respect to Dr. Kehoe. They are as follows: "As you know, Dr. Robert A. Kehoe came to Columbia on June 11th for a preliminary conference with us, and then came back on Saturday the 22nd before the trial for further conferences here and with the Doctors in Florence on Sunday. He went with us from there to the trial and stayed through Thursday, taking the stand himself on that day as a witness for the defense. "Dr. Kehoe made a splendid impression on the court, jury and specta tors. He was moderate in his attitude, clear in his statements, and im pressed all with his desire to give the court the benefit of his scientific knowledge in simple language that the jury and the spectators could under stand. His testimony was of great value to the defense, and over and above that, his cooperation with the attorneys and medical witnesses could not havebeen improved upon.
