To date, your firm has neither certified its ability to meet the applicable emission standards'for asbestos, beryllium, or mercury, nor applied for a waiver of compliance so that necessary controls say be ins talled. Please be advised that operation in excess of the standard after July S, 1973, without a waivei of compliance or a Presidential exemption is a violation of the Clean Air Act, as amended (42 U.S.C. 1857 e_t_ seg) . Conviction of such a_violation say result in a fine of as much as 325,000 per day of violation, or imprisonment for up to one year, or both. Moreover, operators of sources of beryllium or mercury emissions are required by 40CFR, 61.33 or 61.S3, respectively, to test such emissions by the same date, unless a waiver of emi-ssion testing is obtained. An application for these waivers is again enclosed for your use.
