Grocers / La Abarrotera Inspection Date 11/04/2025 PURPOSE OF THE INSPECTION This for cause marketplace inspection was conducted pursuant to the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) Section 8, 7 U.S.C. 136f, and Section 9(a), 7 U.S.C. 136g(a), to evaluate compliance with FIFRA and the regulations thereunder. This inspection occurred for-cause for suspected sale and/or distribution of unregistered pesticides as identified through their website, https://www.laabarrotera.com/. FACILITY DESCRIPTION La Abarrotera is a distributor and retailer that imports and distributes Mexican groceries such as sodas, cookies, detergents, and sweets. La Abarrotera is incorporated in Texas and is estimated to be a Category III size of business. Section II - OBSERVATIONS I, EPA Region 6 inspector, Kiera Hancock, and inspector Justin Mullenix, arrived at C.T. Grocers dba La Abarrotera, on November 4, 2025, at approximately 1:25PM. I entered the facility and spoke with an employee who identified himself as Jose Villalobos Solis. I identified myself and my colleague as inspectors with the EPA and explained the purpose of our visit. I requested to move into an office to review and provide documentation. Inspector Mullenix and I presented our federal inspector's credentials, and I provided a Notice of Inspection (EPA form 3540-2) for review and signature (Appendix 1). Mr. Villalobos Solis declined to sign the document and informed us that he was informed by his boss, Ernesto Macis, not to sign any documents. Inspector Mullenix and I received permission to continue the inspection with the understanding Mr. Villalobos Solis would not sign the Notice of Inspection. It was our understanding that Mr. Macis knew of the inspection since he was contacted by Mr. Villalobos Solis during the inspection. Inspector Mullenix and I asked questions about the store and its activities. Mr. Villalobos Solis stated that he believed the products sold were not imported but bought within the United States. He also confirmed that La Abarrotera is also C.T. Grocers and confirmed he believed C.T. Grocers dba La Abarrotera was an accurate reflection of the company name. I provided a list of products observed to be potentially an area of concern on La Abarrotera's website (URL: https://www.laabarrotera.com/). Mr. Villalobos Solis reviewed the products and stated he did not believe Fabuloso (Spanish Label) or any of the products listed were sold. We then informed Mr. Villalobos Solis that we would look around and review the pesticidal products being offered for sale at the store. Mr. Villalobos Solis, inspector Mullenix, and I entered the warehouse and observed a small assortment of FIFRA-regulated products being held for sale and distribution. Inspector Mullenix took photographs, and we both reviewed the labels (Appendix 3). Following our review of the pesticidal products, inspector 3 C.T. Grocers / La Abarrotera Inspection Date 11/04/2025 Mullenix and I reapproached Mr. Villalobos Solis to discuss the findings of the inspection. We informed him of Salvo Multiusos's label having pesticidal claims while not being registered within the United States. Mr. Villalobos Solis stated that he believed the product was sent to La Abarrotera by accident and to the best of his knowledge, it had not been sold. We all then re-entered the office. I explained the FIFRA regulations and provided him with a Small Business Resource Information Sheet, the Confidential Business Information (CBI) Sheet, and the CBI Notice Questions and Answers. I stated that I will follow up with Mr. Macis for any sale and distribution and invoice records. I informed Mr. Villalobos Solis that a copy of the EPA inspection report would be provided to him via email within sixty days. I then provided a Receipt for Samples (EPA Form 3540-3) for the photographs taken for his review and signature (Appendix 2). Mr. Villalobos Solis declined to sign the Receipt for Samples. A copy of the Receipt for Samples and Notice of Inspection was provided to Mr. Villalobos Solis. The inspection concluded at approximately 2:12PM. Section III - AREAS OF CONCERN During the inspection, the pesticidal product, Salvo Multiusos, was observed to be an area of concern. The product label indicated it is used as a pesticide and was not registered within the United States at the time of the inspection. Label claims for the product included, but were not limited to the following claims: 1. "Elimina 99% de Bacterias" (Eliminates 99% of Bacteria) 2. "Ayuda a Remover Bacterias de la Ropa" (Helps Remove Bacteria from Clothes) Section IV - FOLLOW UP The following information was requested through email by EPA on November 10, 2025, after exiting the Facility on November 4, 2025: 1. Last three years of sale/distribution records for Salvo Multiusos. 2. Last three years of invoices for Salvo Multiusos.
