This was an EPA inspection in response to a National Response Center Spill Report (NRC No. 1402158) which was received by EPA Region 6. The spill occurred on 06/17/2024. The inspection was conducted by the authority of the Clean Water Act (CWA) to determine compliance with Environmental Protection Agency (EPA) regulations. CapturePoint, LLC representative, Talia Clark participated during the inspection. There was no other federal, state, or local agency representatives present at the time of the inspection. FACILITY DESCRIPTION EPA conducted an inspection at the CapturePoint, LLC North Burbank Unit 31 Battery, where an equipment failure on a 4-inch injection line resulted in the release of a company estimated 500 barrels of produced water. The released fluids impacted an unnamed tributary of Hay Creek Section II - OBSERVATIONS I observed the release point of the spill. At the time of the inspection, the 4-inch steel line which failed had been repaired by replacing the failed joint of pipe. I observed dead grass near the release point which extended to the southeast toward the unnamed tributary of Hay Creek. See Appendix 1, photo No. 1. For additional location information and photo metadata, see Appendix 1 (photo log). I observed the point of entry (POE) into the unnamed tributary of Hay Creek. I observed impacted vegetation near the POE and along the impacted tributary. See photo No. 2. I observed the end of spill impacts and the lowermost containment dam which had been placed by the operator to prevent downstream migration of spill impacts. See photo No. 3. Section III - AREAS OF CONCERN The primary areas of concern included the impacted soil and vegetation around the release point, the impacted soil and vegetation across the overland flowpath to the POE and the brine impacted waters along the impacted, unnamed tributary of Hay Creek.
