In response to the referenced memo, I have hastily composed the following statement:
' Pentachlorophenol and sodium pentachlorophenate are recognized industrial toxicants. In recent years commercial pentachlorophenol has been shown to contain chlorinated dibenzo-p-dioxins, primarily
the octachloro derivitive with lesser amounts of heptachloro and hexachloro derivitives. These-chlor inated p-dioxins have been demonstrated to be considerably less toxic than the tetrachloro
p-dioxin which has been found Intthe defoliant, 2, 4, 5-T. The tetrachloro derivitive has not been
found in commercial pentachlorophenol.
After nearly 30 years of manufacture and use, no
known problems have been associated with penta-
' chlorophenol under the proper conditions of safe
handling and recommended applications. Equally
significant Is the fact that no known environmental
. problems have been Identified as being related to
the proper use of commercial pentachlorophenol. In
summary, the available evidence would Indicate that
under the proper conditions of handling and appli
cation, pentachlorophenol has not been associated
' with industrial hygiene nor environmental contam
ination problems.
The above statement reflects our general thoughts. Please feel free to supplement and paraphrase to better fit your needs. Should any further questions arise, please let me know.

In response to your letter of November 7 it is our best scientific opinion, based on our current knowledge of our raw materials and our processes, that the Inert Lubricating Oil, Aroclor 1242 (N215) listed on the attached shee^does not contain any of the 14 carcinogens you have listed**
It may be of interest to you that Aroclor 1242 is no longer sold by Monsanto to companies such as yours. It is sold only as a dielectric fluid to manufacturers of capacitors and transformers who have met Monsanto's requirements relating to understanding of the environmental problems involved and who are willing to assume full responsibility.
I cannot comment on the remaining three items listed because I have no way of determining if they are Monsanto products. If your office can help identify the remaining materials I will try to supply- you with the necessary information.

Recently Cumming Paton had suggested that the Medical Department could perhaps assist us in evaluating the potential impact of health and environmental considerations
on our products. Paul Wright is working on such a program and is considering several approaches at the present time. To assist Paul we have been asked to submit some information on three of our products which could serve as a pilot study group.
The information Paul requested is as follows: Product name, chemical description of each component, amount of component in the formulation, the annual volume of sales, gross pfofit, and number of Monsanto employees exposed to the material.
I suggest that three candidates be selected for which marketing
can supply the volume and gross profit information, manufac
turing will supply the employee exposure information, and
research can help with the chemical formulations and any
additional information relating to potential changes in the
formulations and the like.

I asked Monsanto*s Dr. James P. Mieure, who is associated with
our analytical services group, if he would care to comment.

"Unlike the recent work of Roach at FDA, this paper does not present sound evidence for finding tetrachlorodibenzofuran (TCDF) in Aroclor 1254. In my opinion, the mass spectral
data refute, rather than enforce, the author's implication of identifying TCDF in our product. She isolated material is probably chlorinated methylbiphenyl. One of the authors, A.
Curley, was Informed of thlB possibility' about a year ago by E. S. Tucker in a private communication.
"As correctly sta'ted in the text and illustrated in Figure 1, the mass spectra of chlorinated dibenzofurans contain a multi*
plet of peaks corresponding to a loss of CO Cl (63 mass units) from the parent multiplet. However, none of the mass spectra of Aroclor 1254 fractions in Figure 2 exhibit any evidence of a M-63 multiplet (M/e 24l for TCDF). Hence the parent multiplet
at M/e 304, which the authors attribute to TCDF, must have a different origin. v

Responding to your question under Item 2 of the referenced
memo, it is true that our contention is to keep all analytical
information relating to customer plant effluents confidential.
The information is shared only with representatives of our
customer and no one else.

The NPDES permit system applies to all sites at which waste
waters are generated. Under this system the management of the site petitions the regional office of the Federal EPA for permission to discharge wastes containing contaminants at specified levels. After a considerable lapse of time and much negotiating, a permit is eventually issued. The management of the site must make certain that their operations comply with the provisions of the permit. Any additional ' subsequent standards promulgated by the EPA, for example, the Toxic Pollutant Effluent Standards, which include PCBs, would
take precedence over any previous permit agreement.

I have reviewed the available records, and I cannot find any Instance In which we have a commitment to anyone relating to the analytical procedure used to determine the particle size of our EMA products.
Ihe key criteria used to determine the analytical procedure followed is the validity of the information obtained. If several methods give results that are comparable, the choice of the method should then be left to the chief chemist who remains responsible for the integrity of the data generated in his laboratory.
In this particular case, if my understanding is correct, it appears that Texas City may continue using its current methodology and Luling may use the Alpine Sifter and no problems should arise.

The meeting was held at the request of Joseph K. Wagoner, S. D. Hyg., Director, Division of Field Studies and Clinical Investi gations (DFSCl), National Institute for Occupational Safety
and Health (NIOSH). NIOSH reports to the Center for Disease Control (CDC) in the Department of Health, Education and Welfare (DHEW). Hie participants in the. discussion are as shown In the attached list.
The original purpose was to explore whether Monsanto had a
"suitable occupational group for study" to assess the
potential chronic effects of PCBs. To be included were
.
''PCB-exposed active and inactive workers at Monsanto in a
planned retrospective cohort study." What this would Involve
is obtaining work histories of time spent in PCB departments,
and medical records .of active and still-living Inactive
employees.
The study would not be complete without examination of death
records of those "PCB-exposed" employees-who are deceased --
including those who expired while employed and those who
expired after termination of employment because of retirement
or for any other cause.

Hie proposed study was stimulated by a report from Dr.

Kimbrough, Toxicologist, CDC, to NIOSH, that she had found
an alarming rate of liver cancers In rats fed Aroclor 1260.
Briefly, she found 15 of 180 female rats with "definite
hepatic cell carcinoma" when fed Aroclor 1260 at 100 ppm
in the diet for 22 months. Only one of 173 controls had the
carcinoma. She then described a number of other liver tissue
effects as "pre-cancerous lesions" and found these in 175 of
the experimental rats and In bnly three of the controls.

I have received the various articles and papers which you have mailed to me and I find them both Interesting and. In formative. I sincerely appreciate your continuing concern for matters of interest to Monsanto.
I have Just reviewed the copy of your recent paper relating to chlorinated hydrocarbons in Lake Ontario. It appears to me that the study was very thorough and highly professional. I personally have no specific comments to offer relating to
its findings.
In your letter accompanying the draft of the Lake Ontario
work, you express your concern about the continuing presence of PCBs in waste waters and natural waters. Since I have no specific Information relating to the types of PCBs found, the locations being sampled, and the concentrations detected, I find that'I cannot evaluate the significance of this in formation. I have been hopeful that the amounts of PCBs being detected would be diminishing and as you know, some reports have indicated that this is probably happening. On the other hand, with the relatively high persistence of some of the PCBs, I would not be surprised if we continue to find low
level concentrations for some time to come.
I.find the reference to "measurable amounts of some of the new
*#i4shundred series PCBs in domestic waste waters" extremely surprising. In the first place there is only one FCB mixture designated as a ten hundred type. This mixture, Aroclor 1016,

is a di8tilled version of Aroclor 1242 with the Penta and higher chlorinated homologs considerably reduced. From my knowledge of the distribution of Aroclor 1016 and its appli cation in capacitors, I find the presence of this PCB mixture in domestic waste waters unbelievable. In my opinion the information Just does not make any sense.
You also refer to your colleagues in EPA having an impression that Monsanto is not significantly curtailing the production and sale of PCBs. As you probably know, I have discussed
PCBs with many individuals in EPA and I do not find this impression. I would be veiy willing to review Monsanto's . PCB policy and practice with anyone anywhere. I would appre ciate knowing who lm EPA has expressed skepticism about our
program.
As you know, we currently sell PCBs only to manufacturers of
capacitors and transformers who have demonstrated an under
standing of the PCB problem and have acknowledged full re
sponsibility for preventing this material from entering the
environmnnt. All of our customers are aware of the EPA's
Proposed Toxic Pollutants Standard and have aggressively

taken steps at their plant locations to minimize loss of
PCBs. It is my personal conviction that the PCBs your
colleagues are detecting in the environment in all probability
originated from applications, other than the current controlled
dielectric use.

Samples of ACL'a have been analyzed for heavy metal content including Mercury and in every case the results have Indicated that Mercury content was non-detectable. The procedure used in the limits of detection is identical to that described in Dr. J. J. Jezeski's letter to Bill Francis dated November 1.
Dr. Jezeski also indicated in his letter that two of Sep-ko's products had Mercury contents of 270 ppm and 550 ppm. From our knowledge of our ACL's we are convinced that this high level of Mercury must have come from some other source.
Although the Chicago ordinance limits Mercury in sewerage effluent to 0.5 parts per billion, I do not believe that the development of analytical methodology to detect Mercury in ACL*s in the ppb range is Justified since all normal uses involve dilution to a considerable degree.
Will you please have someone inform Dr. Jezeski that we have
not detected Mercury in our ACL's and the high levels he has
reported in his products would indicate a source of Mercury
having high concentrations,

3. Currently I do not know of any regulation which speci
fically restricts the discharge of PCBs Into water systems.
However, PCBs have been d&signated as toxic pollutants
under Section 307 of the Federal Water Pollution Control
Act (FWPCA). A copy of the latest proposed standards
as published In the Federal Register is attached for your
use.

I have circled the substance which includes Dequest 2006 as an Ingredient, Hie wording Indicates that a chemical reaction is involved but I understand that this has not been definitely established, I believe It is more likely that partial chemical reactions take place.
The limitation shown indicates one percent by weight of the resin is permitted. Since the resin contains about ten percent Dequest 2006, the finished paper product would then contain approximately two poinds of Dequest per ton of paper.
Incidentally, this FDA approval resulted from a petition filed by Monsanto.

Attached is a copy of the September 18 issue of Pesticide Chemical News which reports the existence of a draft' of a proposed packaging regulation, Hie draft provides for child resistant packaging for new pesticides at the time of registration and for previously registered products at the time of re-registration. Product toxicity would determine the type of package required and product is defined as the total formulation in the package in any single ingredient.
I have no information at present regarding the anticipated effective date of this proposed regulation.

reconsider our policy relating to supplying you with a
small quantity of Aroclor 1260. I regret I cannot honor
your request for two reasons. First, Monsanto no longer
manufactures Aroclor 1260 and secondly, the policy of re
stricting the sale of this type of material for dielectric
applications only, although voluntarily implemented by
Monsanto, reflects the thinking of the concerned United
^
States Government departments. In addition a similar policy
has been adopted by the Organization for Economic Cooperation
and Development (OECD), an organization of about 25 indus
trialized nations of the worldeland is currently being considered
for adoption by the European common market countries (EEC).

I reviewed the Ohio Brass skin irritation problem with Elmer Wheeler of our medical department and he assured me that from our description of Irritation and the conditions of use, particularly the high temperature Involved, it.is not indicated that Santobrite is the source of irritation. It would appear under these conditions that HC^ could conceivably be formed and In the presence of moisture an acidic irritation of the skin could occur.
I called Mr. Fitzgerald of Ohio Brass and shared these thoughts with him. He appeared to agree with our evaluation of the situation and seemed relieved that we confirmed his own conclusions. He thanked me for our help and Indicated that he could handle the matter and that we should have no further problems.

Attached is a draft prepared by Dr. Hugh Thompson, EPA, of the "Final Toxic Pollutant Effluent Standards."
At a recent meeting with Dr. Thompson he indicated that he had submitted this draft but many sections were not acceptable to others within EPA. Currently there is con siderable activity within the agency which will result in further modifications to this draft.
Dr. Thompson suggested that the numbers shown for PCB's may
not be altered to any appreciable extent. He also estimated
that the final version will be published shortly after the
end of September.

your memo with Cumming Paton, who incidentally has not
received any telexes from Jack Walsh regarding Power
Engineers problems.

It appears to me that if the Interteen 70-30 is unused material in the original sealed container, that every effort should be made to direct this material to a responsible transformer manufacturer.
I suspect, however, that the Interteen is unusable because of prior use or contamination. If so the only method of disposal that is practical is the use of authorized landfills which are properly operated and properly located. Disposal under these conditions, in my opinion, should present no potential problems. r

I can appreciate the dilemma you fact in responding to BASF's request for 50 grams of Aroclor 1254;.
In his letter Dr. F. Ramsteiner refers to Eastman Kodak studies using Aroclor. I have no record that a sample of Aroclor was sent to Eastman Kodak from Monsanto and I suspect that in any case the sample was obtained prior to the establishment pf .the current sampling policy .
It seems to me that with the small amount of material requested the ass^btion that there is no intention that it be used for commercial purposes or for the development of commercial applications, and considering the reputation of the company involved, I recommend.that in this instance you inform BaSF that you will make an exception and send them the sample.

Confirming our recent telephone discussion, the Monsanto
Company began its program of restricting the sale of PCB's
in mid 1970. Sales were initially discontinued to those uses
in which disbursement to the environment could not be con-
trolled--for example in adhesives, caulking materials,

plasticizing applications and coatings. During 1971 sales
to paper coating, heat transfer and hydraulic fluids applica
tions were also terminated.
Since December, 1971# sales of polychlorinated biphenyls have been limited to applications as a dielectric fluid in capacitors and transformers to customers approved by Monsanto.

Confirming our recent telephone discussion, the Monsanto
Company began its program of restricting the sale of PCB's
in mid 1970. Sales were initially discontinued to those uses
in which disbursement to the environment could not be con-
.
trolled--for example in adhesives, caulking materials,
plasticising applications and coatlrgs. During 1971 sales
to paper coating, heat transfer and hydraulic fluids applies-
tions were also terminated.
-
Since December, 1971* sales of polychlorinated biphenyls have been limited to applications as a dielectric fluid in capacitors and transformers to customers approved by Monsanto.

As I mentioned over the telephone, prior to 1971 Aroclor 1242 was produced and used in the greatest amount. Starting in 1971 Aroclor 1016 has beoome the most predominant polychlorinated
biphenyl mixture sold.
The percent of each homolog present in the currently available
Aroclors is shown in the enclosed table which may also be found
in the report entitled "Presentation to the Interdepartmental

copies of our Analytical Methodology for the determination
of vinyl chloride monomer in our ethylene vinyl chloride
latices.

Attached is the latest revision prepared by Bob Keller's group. Note they used a pilot plant sample with low residual vinyl chloride to validate this method.
Bill Richard has expressed concern regarding the sharing of
this information with our customers at this time. As you
know, we have informed these customers of the current levels
of monomer in our products. It appears to me that having
access to this methodology will not be revealing new information.
I recommend that.this method be shared with our customers on request. May I have your approval. . ; ,

Material Safety Data sheets, trade literature, toxicity statements, etc. In most cases this type of response appears to satisfy our customers' needs.
There may be an occasion when a customer =: requires additional
Informationv--For example the attached questionnaires from
Chevrolet Motors Division. For these situations the repre
sentatives of the marketing function must decide:(l) Does
the account warrant special consideration (2) Is the infor
mation requested considered commercially sensitive (3) What
is the potential for establishing undesirable company
commitments and liabilities?

If the decision is made that we must concur with Chevrolet'srequest, I would suggest that Information required to com plete the form be obtained from the appropriate staff group. The medical department should review and contribute toxicity and health Information, the research department should con tribute physical and chemical data, and finally a representative of our legal department should review the final document
before it is forwarded to Chevrolet.

As discussed during our telephone conversation of July 3# the Occupational Safety and Health Administration is conducting hearings on the proposed permanent standard for occupational exposure to vinyl chloride. The hearing began on Tuesday, June 25 and continued through Saturday morning, June 29. The hearing is scheduled to resume on Monday, July 8.
I have attached a schedule of appearances which you may find interesting. In general, the vinyl chloride and polyvinyl chloride producers are contending that the proposed standard cannot be met and they would be forced to terminate their oper ations. The users of polyvinyl chloride contend that their operations are in compliance and therefore they should be excluded from this regulation. The labor representatives and Health Research Group are supporting.the proposed standard.
In response to your inquiry relating to my opinion regarding the level which will be promulgated, I can only speculate that it will be less than 50 ppm but some number greater than 1 ppm; perhaps 15 - 25 ppm. I estimate that the final standard will be published by mid-October.

I have reviewed with George Levinskas the acceptability of the Scripset 700 liquid resins by PDA as components of paper and paperboard.
In my reference memo I had indicated that Scripset 720 might have questionable status. I now believe that Scripset 720 can be considered acceptable since ammonia is included in the GRAS list (generally recognized as safe), and the styrene-malaeic anhydride copolymer are also listed in Section 121.2526.
I recommend that reference to FDA coverage be as follows:

The information you requested relating to water solubility of PCB formulations is not available as a reprint since it was verbally presented at the March 17i 1970, meeting held at the National Water Quality Laboratory, Duluth, Minnesota.
The results I reported were obtained in our laboratory by dissolving commercial PCB mietures in distilled water at 25 C. The quantity of PCB 's in the saturated solution was determined by GLC/EC. . Results were as follows:
