Mr. Kull has asked me to familiarize you with the above captioned claim.
is a 40 year old woman who was formerly employed as a part-
time bookkeeper at our store #5441 in Syracuse, New York. In November,
1978
informed store manager,
, that she was suf
fering from "chemical luekemia" which her doctor related to her work
environment. This matter was immediately reported to
on
November 22, 1978. Dave did not inform our department concerning this
allegation nor did he take any action concerning this matter thru your
department. He merely "shrugged off"

In January 1979, we were advised by L
that i
was
asking questions concerning the manner in which she could file an occu
pational disease claim. It was at this point thati
contacted
our department concerning the handling of this matter. Since it was the
opinion of both our department and
: that
claim
was somewhat groundless, we decided to contact the Aetna before filing an
injury report. Aetna's clairts manager in Syracuse, New York, John Mulcahey,
advised us not to file an injury report with the State of New York since
he felt this would somewhat indicate an admission of liability on the part
of the Employer. However, Mr. Mulcahey did state that we should advise
that she should contact the State of New York, Workers' Com
pensation Board, for assistance in filing her claim if she so desires.
On January 30, 1979, Mr. Myonnes received notice from the State of New
York that
: had filed her claim. The State advised us that it
was now our responsibility to submit an Employer's report concerning Ms.
Prusik's claim. Through the cooperation of Mr. Myonnes and the Aetna,
we submitted a negative Employer's report indicating our denial of
claim. This matter is now being scheduled for a hearing before
the Workers' Compensation Board of the State of New York.
We are enclosing copies of miscellaneous correspondence pertaining to this
claim. Included in this correspondence is a medical report from the
claimant's attending physician, J. Robert Smith, M.D. Aetna is currently
attempting to obtain a medical examination of f
by a physician
of their own choosing. They are also compiling a complete medical history
of by obtaining information from previous physicians that have
treated her.
