As we discussed, I attended the first pre- trial conference at the Industrial Commission in the referenced claim on September 29, 1987. Dennis Miller did not attend. I informed Lisa Grosse, Michael Gilday and Kenneth Baylen, who presided at the conference, that settlement discussions had been taking place in the case. I also informed them that no settlement had been reached to date. Michael Gilday stated that they would merely reschedule another pre-trial conference in three months. I will again report to you after the next scheduled conference. Please keep me advised of ongoing settlement negotiations. If you are unable to settle, I believe that we should schedule the deposition of the claimant as well as the deposition of the claimant's treating physician, Dr. Ford.
